It looks factory, right down to the engravings. I guess berettausa is the only way to ensure I get the real deal.
Which seller did you get it from? If it was ben-n-terrys I'd feel pretty confident that it's a legit Beretta mag.

This does remind me of an issue I had with one Smith & Wesson SD9 magazine. It would lock the slide back on empty about 50% of the time. Short story short, the ridge on the top of the plastic follower was molded so that it stuck up too high (excess material). The ridge would make contact with the underside of the slide before the follower could rise far enough for the slide stop notch on the follower to make solid engagement with the slide stop tab. I sanded down the ridge a bit. This allowed the follower to rise higher and properly engage the slide stop tab.

I only bring this up in case you really feel like monkeying with the magazine, but I'd be inclined to return it instead.
 
The Chinese knock off everything these days & have gotten really good @ mimicking the OEM markings. Leupolds (sadly) have been faked a lot. Your magazine may be genuine. Or not. That's the frustrating thing about eBay - tons of fake crap being sold as real. Since your mag did NOT work as the genuine OEM product should, I'd get a refund & try a different, more reliable source for the next magazine purchase. But I think you already reached that conclusion.

Hey, I bought some 10/22 mags on eBay in OEM packaging & they are jam-o-matics. They say they are Ruger & labeled as Ruger and came in packaging that looks like Ruger, but they function like Chinese chit. Tried to save a few bucks & wasted money instead. We've all been there. Thanks for the refresher & reminder that eBay is still...eBay.

Yes, I did buy it from Ben-n-terrys. I believe I will keep it and see if it just needs a "break in" period. Otherwise, it will be my #2 or $3 magazine. Thanks for your advice.
