Never heard of one. Lever actions are usually chambered for rimmed cartridges, like .44, .357, etc. .40 S&W is more likely to be found in a semi-auto.
 
Below is a post from a thread I started on Calguns.net on the same subject. There is a Ruger (PC4) and Hi Point that comes in the .40 I think, but not legal in CA.

Sorry DrDriller, guess I was misinformed on the PC4 and the Hi Point, they are both carbines that use mags. I have a pm to that Debbie at EMF for an ETA on their levers and other arms---will post what I find out. I'm looking for one too. Sorry about the mis-info.

I have never heard of, or seen a 40S&W lever action rifle.

It's probably the same reason there are no lever action 45ACP or 9mm Parabellum ones either - the action is designed around rimmed cases.

If you need to throw a 40 cal. bullet - get a 38/40 Winchester in a Winchester model 92 (or 92 clone), a great rifle since 1892! :supergrin:

I want a .40 lever instead of 357 or 45, because I have a lot of .40 ammo, and shoot .40 Glocks. I consolidated all my firearms to the .40 in handgun, .223 in rifle, and 12 gauge in shotgun. I hated having a huge variety of ammo to account for.

If I could shoot my handgun round in a rifle, that would be awesome.
 
I've never heard of a .40 levergun, rimless calibers (.45acp, .40 S&W for example) don't lend themselves to the action in leverguns. There is a reasonable selection of .40 semi auto carbines available.

You might talk to the the guys at Paco Kelly's levergun forum also.
