    The sad thing is the Troop will probably never see a dime from this loser, especially while he's locked up for attempted murder of a police officer. But...this does need to happen more often to send a message. I completely support the law suit. It's amazing how many officers are sued for wrongful death, excessive force, yada yada yada. It is very refreshing to see an officer flip the table back on the pieces of trash that do this to us. More need to do it, as often as possible.

    I always wondered why this wasn't common practice. I mean why can't I sue the crap out of the girl that kicked me in the knee last year? Of course, you can't get blood from a stone but it would be sort of fitting since you know they would do it to you if it was them injured.

    Is there something in civil law that prohibits us from suing due to work related injury?

    An officer in my department has sued people two times, won both, and collected on both. Both times someone assaulted him, and he sued for smaller amounts (higher chance of collecting). $3 million doesn't seem like enough in this trooper's case...

    Wish I knew some attorneys. We could start up Law Enforcement Legal Offence Fund. Any LEO with a winnable case could sign up for X% of the winnings fee and have his case go forward without costing them anything except some time.
    Some of the items that come to mind are:

    Assault.
    Exposure to Hep or HIV.
    Mental Anguish for person and family.
    Lost wages to injuries.
    Vehicle Accidents.
    Ringing in the ears (when your forced to shoot someone).
    Stress related calls, DV, Child Rape, Suicides, etc.

    Just might get someone an early retirement.

    Good for him. Even if he never collects all of the money, hopefully he gets a house, cars, and whatever else the scumbag owns.

    SKSMan and Spdski will both be lawyers within a few years. I am a lawyer now and love the idea.

    However, in negligence theory, there is an acceptance of risk defense that when you undertake an activity, such as a job, you accept some of the inherent, foreseeable risks in the job.

    Not sure how the state of the law is in California as I don't do civil negligence law, but there are inherent risks of the job in policing so not it's not so black and white.

    EDIT: As to the defendant (suspect), their intentional harm towards you will be proceeding on the battery theory that they caused an unwanted contact which caused you harm. You will likely prevail as nobody would want that but what I was talking about was in a pursuit scenario or other cases where it's not so direct but was still as a result of someone else's actions.

    I agree with both this and what Gos said. If I were you, I would try to get a-hold of Massad Ayoob and ask him what he thinks of this, or more importantly, if he knows of any "LEO Legal Defense Fund". It's a very good idea, and he's probably one of the foremost experts in the field of LEO Legal Defense.

    opsk: Not necessarily true. If the shooter had auto insurance, and a case can be made that he was in, around, just left, or operating his vehicle, then the auto insurance may kick in. There is a lot of new and interesting litigation around this very issue.

    Now, I doubt that a dirtbag like that would have $3mm in coverage, but he may have some amount of coverage.

    Understand that this is a pre-emptive move to prevent the family from liquidating their assets in a manner to either bail out the suspect and get him to flee pr to simply make it impossible for them to transfer the assets to someone else to prevent collection or restitution.

    Pretty dang savvy in my book!

    Also understand that the trooper had a profitable side business he will now be forced to close as a result of the shooting. That plays into things . . .

    (Dang! Maybe I need to go to law school now. Hey Ski! Could I survive without choking the snot out of some prof.?)
