People really news to pay attention to the links they click on. It's pretty easy to make a web page install malware especially when you have to click on buttons like that poll does.

Is that a really old poll, or are they not aware that the Supreme Court has already settled that debate?

They would have better legal grounds (other than the number of cases decided) for asking "Does the 1st Amendment protect your from actions by state and local government?" After all, the 1st Amendment specifically says it ONLY protects you from laws enacted by the U.S. Congress.
