See above. He has several options when it comes to a prosecution that is in direct violation of someone's basic rights.

If the gate is not locked, and you are asked to leave private property and you don’t, it is a crime. If you go into to local box store, entering through unlocked doors, and start throwing a fit and are asked to leave..it is trespassing if you don’t.

If the gate was locked, as the 911 call indicated, and broken, it could then be a more serious crime.

I finally see the value of a bayonet lug on a civilian rifle.....

You would be wrong, though I know that doesn't matter to you, and the gate was torn down by the protesters who cut the chain on the gate.

    Read what I wrote....

“to be fair, I’m pretty sure the gate was not locked; and it was not damaged by the first rioters entering.“

See ? Gate intact, no chain anywhere. If you are going to be a dick, at least be pretty sure you are correct.

I never said it wasn’t trespassing. (ETA: In fact, I wrote twice that it was). If the property was posted, which I have heard (but not seen), a person doesn’t even have to be told to leave for it to be trespassing.

Those options look like a stretch of the imagination to me. Not a chance in a billion, short of somebody uncovering a recording of her promising to make up fake charges and admitting she knows it's false - that is unlikely since it isn't really false. The prosecutor can usually ignore a person's justification and make them prove it and there is nothing illegal about that.

There was a sign saying private property, when you go past that you are trespassing.

I've seen this picture posted a bit, so this is all I have to go by. My assumption is that the protesters did this, hard to argue otherwise.

There is a video out people are using to assert that it wasn't lock...though, coincidentally, it begins after the gate was already opened presumably by the law-breaking trespassers.

    I am trying to understand.

The trespassing criminals (and some in this thread) are saying it was OK to trespassing because the gate was damaged by someone else.

Could be good case law. "I went inside and took everything I wanted out of that house, but it wasn't burglary or illegal because "someone else" already broke the door down"

Looking at the house and general condition, we should assume that the gate had been like that well before the rioters ever arrived. The house they are looks like maintenance of a gate would have most likely been neglected and they would have left a broken gate for months or even years...

Agreed. In fact, the entire community was a blight and its whiteness should be torn down. They deserved what they got in that little privileged community in which they think they can just segregate from the rest of society with a man-made sign. Not in my America.

The very fact that he stated he was getting involved is 'doing something about it'. It exponentially changes the game-theory.

It's much like publicly signaling a veto-threat and a DOA bill. Any case brought against the lawyers, and no case will be brought now, is DOA...especially in the eyes of the DOJ. The governor now has a green-light to pardon any frivolous suit brought, also.
