I guess my card fell out of my pocket somewhere along my 6-mile hike this weekend. I wasn't carrying a whole wallet, just the CHL card in my pocket because I was carrying my pistol. Anyway, I've already ordered the replacement card. Does anyone know if it's legal to carry until the new one shows up?

Given the possible consequences, I would think this question better directed to the State DOJ.

Considering you cannot be in accordance with this part of the law without a physical license, I'd say no:

Sec. 411.205. REQUIREMENT TO DISPLAY LICENSE. If a license holder is carrying a handgun on or about the license holder's person when a magistrate or a peace officer demands that the license holder display identification, the license holder shall display both the license holder's driver's license or identification certificate issued by the department and the license holder's handgun license.

Did you have your DL with you as well? Sounds like that is a requirement.
Not if you're hiking...

He probably drove there,parked and grabbed his CHL and put his wallet up and went hiking.


I could be wrong though.

1. you do have to have your driver's license or some other form of state ID with you when carrying as well as your CHL with you. (Doesn't make sense to me since the CHL is almost identical to the DL, and it's a state Issued ID. Go figure)
2. you CANNOT carry concealed unless you have your CHL with you while carrying.
3. you CAN carry a concealed and loaded weapon in your vehicle with you as long as:
a. you carry the weapon directly from a premises (home) to your vehicle and vice versa
b. you are not disqualified from possessing a firearm for any reason (gang member, ex con, etc)

Sorry you lost your card - that sucks - no other way to say it

You can not carry without your card - you will be in violation of the law

from the Tx DPS website

"You must have a valid license in your possession to carry a concealed handgun on or about your person outside the confines of your home or vehicle. However, the exception to this answer is the concealed handgun may be carried in your vehicle as long as you comply with the requirements of Section 46.02, Texas Penal Code."

Thank goodness this does not have an impact on your ability to carry in your car as per MPA (as noted above 46.02)

It is not legal. This is the actual reason why:

PENAL CODE

TITLE 10. OFFENSES AGAINST PUBLIC HEALTH, SAFETY, AND MORALS

CHAPTER 46. WEAPONS

Sec. 46.15. NONAPPLICABILITY. (b) Section 46.02 does not apply to a person who:
(6) is carrying a concealed handgun and a valid license issued under Subchapter H, Chapter 411, Government Code, to carry a concealed handgun of the same category as the handgun the person is carrying;

That's not true.
Is true, per the statute.

There is no penalty for violating that "statute". Also, a person does not need a DL to qualify for a CHL and does not need a DL to receive the non-applicability to UCW afforded by the CHL.

you can carry it in your car without your chl, but must have your chl to carry concealed....

dont count on getting a break from the law if you are cought doing otherwise...
