swiss knife, DEADLY weapon???

    was recently stopped, AGAIN, at a check point, and our fine PNP saw a swiss knife in the center console of my car... apparently a swiss knife is a now deadly weapon, the officer told me to get out of my vehicle because i had a deadly weapon(my swiss knife).

    is a swiss knife really a deadly weapon? based on philippine law?

    maybe the cops thought i would be using my cork screw to assasinate some politicians???

    the cops told me, i had to go with them to the precinct. i tried to be civil and polite, but ended up dropping names, and flashing various business cards.
    to put the long story short, the cops finally let me go, along with my swiss knife.

    beware of these check points in the binondo area.

    Its clearly harassment. They were probably after your swiss knife to be a freebie...

    Had the same instance a few years back but eventually let me go with it too.

    Maybe our lawyer BoGs can give us a point-by-point rundown on how to rebut the accusation that may be levelled by some LEOs regarding the "deadly weapon" nature of a swiss knife.

    this is plain and simple harassment. unless the swiss knife is used in a crime, i doubt if any prosecutor in his right state of mind will recommend charges on the basis of possession. he'll become the laughing stock of the legal community

    when i was still active in mountaineering, we carry our swissknives openly, some use it as a necklace along with a small maglite, some carry it OWB. we were everywhere..even at airports, no problems.

    of course, ibang usapan kung bowie knife ang dala namin.:animlol:

    pnp said, "kasi gun ban po",

    i said, "oo nga, swiss knife lang yan"

    other pnp said, "deadly weapon pa din yan"....

    apparently, i would be assasinating some polititcian that night with a my bottle openner of my swiss knife...

    ano ba ang caliber ng swiss knife mo? ilan ang magazine capacity? :rofl: harrassment lang talaga yan d ba nila alam ang pagkakaiba ng gun sa swiss knife? pinagpilitan pa na gun ban daw! bobo talaga.

    reminds me of an incident last year.

    two bogs were riding a car, their open blasters at the trunk as per ptt

    they were stopped by a pnp checkpoint

    after presenting their papers for the open pistols, one of the cops said, they still need a permit to carry:shocked:

    meron ba namang hangal na mag-dadala (owb or iwb) ng open blaster, eh race gun yun. shunga shunga:upeyes:

    hindi naman specified ang deadly weapons, subject to court interpretation.

    swiss knives will definitely hit the roof, common sense dictates kasi

    how did they see it in your compartment in the first place?

    they are not supposed to go inside your vehicle. they can only look from the outside thru the windows.

    but even the lowly nt cutter utility blade is now considered a deadly weapon

    As far as I can remember correctly... any blade less than 4" in length is legal. Basta bangitin mo lang sa pulis yun... they'd know that ur aware of ur rights and paalisin ka na nun. Kung hindi man... tumawag ka sa abugado siguradong mayayanig mga yun.

    The Comelec gun ban directive has given a very wide latitude for interpretation to the people enforcing it. Jojo is probably right in the sense that if you are in doubt (as to whether your knife or any item you are carrying which maybe categorized as "deadly" weapon), you should not be bringing it with you in your person or vehicle.

    We could turn green arguing with the LEO's at the checkpoints that what we have is not a "deadly" weapon and most probably the prosecutors will dismiss the case as soon as it is filed, but is it worth the hassle?

    If you plan to carry something with you for your protection, then by all means just bring a big and nasty gun. Then there'll be no doubt that it is really a "deadly" weapon.

    Of course, it goes without saying that you have to have the necessary Comelec gun ban permit for it so that you can carry it with you. :tongueout:

    Sorry but this is not true. The law does not qualify. Regardless of the length of the blade, you can still be held liable.

    You mean even a swiss knife can get u arrested? Hmmm... pulis pa man din ang nagsabi sa kin nun. BOGs lawyers... can you shed light on this?

    better stay home guys!

    anything and everything can be considered a deadly weapon.
    your pen can stab
    your belt can choke
    your hands and fist can crush
    your cds/dvds can slash
    your car keys can stab
    your shoes, watch can cause blows to vital parts
    sometimes even the face or the looks can kill

    i guess they are simply there for the kotong
