Supreme Court Justice Stevens to Retire in Summer

    WASHINGTON—Supreme Court Justice John Paul Stevens announced Friday that he will retire from the court this summer.

    Justice Stevens said in a letter Friday to the White House that he would step down when the high court takes its summer break.

    "Having concluded that it would be in the best interests of the court to have my successor appointed and confirmed well in advance of the commencement of the court's next term, I shall retire from regular active service as an Associate Justice ... effective the next day after the court rises for the summer recess this year," Justice Stevens wrote.

    His retirement gives President Barack Obama his second opportunity to appoint a member of the Supreme Court. Last year, Mr. Obama named Sonia Sotomayor as the court's first Hispanic member in filling the vacancy created by Justice David Souter's retirement.

    The timing of Justice Stevens announcement leaves ample time for the White House to settle on a successor and Senate Democrats, who control 59 votes, to conduct confirmation hearings and a vote. Republicans haven't ruled out an attempt to delay confirmation.

    The leading candidates to replace Stevens are Solicitor General Elena Kagan, 49 years old, and federal appellate Judges Merrick Garland, 57, and Diane Wood, 59.

    Justice Stevens' departure won't change the court's conservative-liberal split because Mr. Obama is certain to name a liberal-leaning replacement. But the new justice isn't likely to be able to match Justice Stevens' ability to marshal narrow majorities in big cases.

    Justice Stevens was able to draw the support of the court's swing votes, now-retired Justice Sandra Day O'Connor and Justice Anthony Kennedy, to rein in or block some Bush administration policies, including the detention of suspected terrorists following the Sept. 11, 2001, attacks, its tilt toward protecting businesses from some lawsuits and its refusal to act against global warming.

    Chief Justice John Roberts said in a written statement that Justice Stevens has earned the gratitude and admiration of the American people.

    "He has enriched the lives of everyone at the Court through his intellect, independence, and warm grace," Chief Justice Roberts said.

    Before accepting any more Marxist freaks being imposed upon us by Barry Soetoro, he needs to prove to we the people that he's eligible to be issuing White House directives.

    How come Bush even had to show his national guard service records, and 0bama doesn't have to show us ****?

    No change for conservatives. Though a replacement could be a radical liberal as opposed to Stevens who was by all accounts a moderate.

    At least Obama will replace one liberal with another. Hopefully after 2012 this won't be an issue anymore.

    We've been lucky twice now. So far Obama has not been able to change the balance of power in SCOTUS.
    With just a little more luck we can vote him out before that happens.

    You can bet Stevens is retiring now so that liberals still have a chance on the court. This is why Dem's want to push the process before the next election cycle because they know it will be a Republican sweep.
