I know these threads usually don't go to well, but I will try to be as detailed as possible.

It's Friday night. You and your wife are having a party at your house to celebrate her birthday. There are about 10 people there, all close friends. Your wife has had a few drinks, you have had two beers. At about 9:00pm, one of your wife's "good friends(a guy)" shows up with two questionable and obviously intoxicated guys. About an hour goes by, and they've thoroughly pissed off everyone at the party, nobody is having fun, any everyone decides it's time to get them to leave.

While everyone is out in the back yard, you decide to tell the guys and wife's friend that the 3 of them need to leave. You have the support of the entire party, and everyone helps escort these guys to the front, which has remained peaceful so far. While out front, the wife's friend goes back to his truck, starts it, and waits. The other two light up a cigarette, still standing in the front yard. About 30 seconds later, they look at eachother, and the biggest one takes a swing at your good friend, knocking him out cold on the ground, his head hitting the sidewalk hard.

Same guy swings at you, you duck and miss, and as you turn around, the second one swings at you, all while the first one has now started swinging at the two girls that are outside, including your wife.

If you are carrying in this situation, do you draw? Fire? Engage in a fistfight with two guys that are both twice your size?

I guess the key factors here are justifiable force and alcohol. You have two beers, but are by no means intoxicated, plus you're on your own property. The two guys starting the fight are obviously very intoxicated. You've already established that they are no longer welcome on your property, and they've now engaged you and your loved ones in a physical confrontation, on your property.

Sorry for the long post. Obviously a similar situation happened to me about a year ago, and I was lucky enough to have some friends there that helped out before it escalated, but to this day I still think about it.

The question of what is a suitable response seems to come up often. You must be familiar with the laws in your state. i'm not a lawyer. In Florida many people have gone to jail for the required three years for drawing (not necessarily using) a gun to avoid a butt whoppin. In one often used example a man being beaten by a neighbor with a garden hose shot the man in the chest. He went to jail. You must be aware of all the gun laws in your state.

The better option would have been to ask them to leave if they refused call LEO's to escort them out! Problem solved!:wavey:

They started to leave peacefully then right before they stepped into the truck they started swinging and going nuts. It happened pretty fast.
So, the guys light cigarettes and are standing there for 30 seconds.....and your're still standing within punching range? Why didn't you go back into the house?

A fist-fight doesn't mean you're going to get killed, by the way.....unless you can explain it to a jury. Good luck.

I thought nobody wanted to be around these guys, so why are we hanging around with them outside? They've been escorted to the door, so why have you gone out there to be with them?

If you are drinking you should not be carrying.

No. The others at the party need to be invited to assist, if they don't there should be options beyond engaging in a fistfight. IME, never hit with the hand if you can hit with somthing else.

If you're going to have get togethers like that, it may be a wise idea to have some alternate means of dealing with people like that on hand.

Drunken dude starts a fight and you taser him, thats not going to be too hard to explain, especially with as many witnesses you should have, he's probably just gonna go home with some wet pants.

As someone already mentioned, all depends on your state laws, but it sounds like it'll be tough to prove grave and immenent danger, as well as a disparity of force, which seems to be present in most state laws that I'm aware of.

Your pack easily outnumber the rabble-rousers so it'll be tough to prove that you needed to draw.

How about a double-leg take down, hold down until friends can subdue, then repeat, call 911?

IANAL, YMMV, IBTL yadda yadda.

a no shoot situation. Someone will witness and call police. That or you can. The friend of your wife's is a real ****** for bringing butt heads like this to your house.

I never let them in the door,, If they came to my home intoxicated they can go somewhere else and disrupt that persons life.

Intoxicated = affected by a substance that intoxicates.

You are affected... Shouldn't be carrying..
Not always true.


A blood test woud be needed seen plenty normal healthy males above 200lbs that have consumed 2 12 oz beers with food over a few hours and seen the breathalizer blow double goose eggs or a .01.

Yeah but it's your party, do you want to take the chance? carrying while you're drinking hoping it wears off before you're arrested...

That's why I stressed the importance of the party being at MY HOUSE. I was carrying IN MY HOME. I cannot be arrested for that. Even when things went outside, I was still close to the door, and ALWAYS on my property.

Honestly, that was a real dumbass move of everyone, including me, to continue standing out there at that point. I guess it was kind of a "let's make sure they actually leave" type of scenario. Very dumb indeed.

The big guy knocked my friend out cold, swung at me, then was swinging at the girls by the time I was turned around. Two of my friends took him down, but it took quite a bit of effort. At that point ****** #2 started trying to get them off of his friend. He was taken down pretty quick. Friends backed off, two dudes jumped in their buddy's truck, and they were gone before the cops got there(neighbor called). Don't know why they were let go, but I wasn't the one holding them down, so not much I could do. The friend who got knocked out has a terminal illness, so he tried pressing charges, but I guess the detectives chose not to pursue it that far, even though we knew all their names, had plenty of witnesses, etc.

Have a link? I am not familiar with FL laws but I travel there often for family.

This. .

Once they are out the front door, Stay inside and lock the door.

After that, call 911 if they continue to be jerks. .

If I recall these cases had situations where the "fight" was disengaged, and the production of the firearm was brought in and escalated the situation. If it's in your yard, and you reasonably believe that you or another's life is threatened, or great bodily harm is threatened, you are justified.
