SB 235 Personal Protection in Restaurants (NC)

    NC state Senator Brock has introduced Senate Bill 235 Personal Protection in Restaurants. Please contact your NC State Assembly members and support this bill which would allow concealed carry in NC restaurants that serve alcohol.

    May I suggest to the Administrator that the sticky above that details the Pending Legislation in NC be deleted as it is last years list of bills that were introduced, and all will have to be re-introduced this year with new numbers.

    If you don't know your 9-digit zip code, you can get it by keying in your address using the USPS - ZIP Code Lookup Tool.

    Actually, the representative lookup on the NC State Assembly web site might not be 100% accurate. For absolute assurance that you're contacting your correct representatives, use NC State Board of Elections Registration Lookup. You'll have to be a registered voter to use that one, though.

    1 A BILL TO BE ENTITLED
    2 AN ACT TO ALLOW PERSONS WITH CONCEALED HANDGUN PERMITS TO
    3 PROTECT THEMSELVES AND THEIR FAMILIES IN RESTAURANTS.
    4 The General Assembly of North Carolina enacts:
    5 SECTION 1. G.S. 14-269.3(b) is amended by adding a new subdivision to read:
    6 "(5) A person on the premises of an establishment that is a restaurant under
    7 G.S. 18B-1000(2) or G.S. 18B-1000(6), provided the person has a valid
    8 concealed handgun permit under Article 54B of Chapter 14 of the General
    9 Statutes."
    10 SECTION 2. This act becomes effective December 1, 2009.

    We need to get a congress-person to put forth a similar bill for the house.

    SECTION 1. G.S. 166A-3 reads as rewritten:

    § 166A-3. Limitations.

    8 Nothing in this Article shall be construed to:
    9 (1) Interfere with dissemination of news or comment on public affairs; but any
    10 communications facility or organization, including but not limited to radio
    11 and television stations, wire services, and newspapers, may be requested to
    12 transmit or print public service messages furnishing information or
    13 instructions in connection with an emergency, disaster or war; orwar.
    14 (2) Limit, modify or abridgemodify, or abridge, except as provided in
    15 subdivision (3) of this section, the authority of the Governor to proclaim
    16 martial law or exercise any other powers vested in him under the
    17 Constitution, statutes, or common law of this State independent of, or in
    18 conjunction with, any provisions of this Article.
    19 (3) Authorize the taking, confiscation, or seizure of lawfully possessed firearms,
    20 ammunition, or ammunition components."

    SECTION 2. Article 36A of Chapter 14 of the General Statutes is amended by
    22 adding a new section to read:
    23 "
    § 14-288.1A. Limitation.

    24 Nothing in this Article shall be construed to authorize, or to allow ordinances that authorize,
    25 the taking, confiscation, or seizure of lawfully possessed firearms, ammunition, or ammunition
    26 components."

    SECTION 3. G.S. 14-288.7 reads as rewritten:
    28 "
    § 14-288.7. Transporting dangerous weapon or substance during emergency; possessing

    off premises; exceptions.

    30 (a) Except as otherwise provided in this section, it is unlawful for any person to
    31 transport or possess off his own premises any dangerous weapon or substance in any area:
    32 (1) In which a declared state of emergency exists; orexists, unless the dangerous
    33 weapon transported or possessed is a lawfully possessed firearm,
    34 ammunition, or an ammunition component; or
    35 (2) Within the immediate vicinity of which a riot is occurring.

    Would also be nice if there were provision included, to (1) NOT increase taxes on gun or ammunition purchases above the normal taxes during times of Emergency and (2) NOT suspend sales of guns or ammunition during an Emergency. (3) Expand Personal Protection of self, family and personal property if a perpetrator / intruder illegally enters or takes your property.

    My Rep and Senator are pretty pro-2A, but I imagine plenty of others need a lot more pushing...

    So are mine. I am glad for that. I just sent anoter email about the other bill. It is a little hard to read. As I understand it, it says that the state can not take your stuff...in a nut shell :supergrin:
