    A Republican congressman touched off a firestorm Tuesday after claiming on Twitter that his office had information suggesting the FBI leaked information to the press and used the resulting articles to help obtain surveillance warrants.

    "We've learned NEW information suggesting our suspicions are true: FBI/DOJ have previously leaked info to the press, and then used those same press stories as a separate source to justify FISA's," House Freedom Caucus Chairman Mark Meadows, R-N.C., tweeted overnight.

  6. I think the democrats underestimate Trump. Remember that Trump has the power of the presidency. If the democrats win the congress, Trump should call their buff and fire mueller, Rosenstein. The democrats will impeach him no matter the truth is.

    After he fires them, he releases everything including how the democrat congressmen colluded or met with russians to try to get dirt on Trump. Then let his info be known on the senate floor. The press will carry the story live. We all know that the democrats in the senate will not have enough votes to throw Trump out. The swamp will be drained ( not completely) , the press embarrassed. And 40% will continue to believe the democrats lies, but the other 60% will know

    Huber has been investigating this for more that 5 months. It was revealed yesterday that he has yet to interview Bruce Orr. Good luck getting any real closure and subsequent indictments on this.

  12. I am curious how a judge can consider a story based on an anonymous source to be "evidence." An anonymous source whose claims haven't been verified by investigation isn't enough evidence to allow the police to conduct a traffic stop (Alabama v. White), but a search warrant or wire tap requires the higher level of evidence necessary for the police to arrest.
     
  13. Giving politicians posing as cops power to apply for secret warrants...what could go wrong? Anyone who works in any leo agency will tell you that most who seek higher ranks often are just politicians with a badge.

    And social media will do everything in their power to steer their users away from any mention of it.
     
  15. It’s a FISA warrant . Big difference.

    The second part of using the media source was collaborate the main source which was Steele. It wasn’t the “main source” to the court’s knowledge but Steele and the news source just collaborated his report. They did not know Steele was the News source. They also weren’t informed that Steele had lied. They were told he was a credible and reliable source.

  19. If you are old enough, you will remember Walter Winchell. A number of his "tips" came from the FBI-right from the top. Same with Drew Pearson. You know Mark Felt as being "Deep Throat", an authorized spokesperson for the FBI who regularly met reporters in the public. There have always been leaks.

    However, what the FBI did through its top people went beyond routine leaks. There was a concerted, but not necessarily conspiratorial effort by employees and top people to influence the 2016 presidential election and delegitimatize the current presidency. Yes, Nixon should have been removed from office for using a simple burglary to advance his re-election. However, the conduct of FBI and DOJ employees is much more extreme. The conduct can not be rationalized. A number of people have gone and need to go, whether fired/forcefully retired/criminally prosecuted or otherwise handled so that they be properly humiliated and never be in the employment in the public sector in the future.
     
  20. Huber can’t interview Ohr without jeopardizing the case. Garrity v New Jersey probably applies. There has to be a “firewall “ between the two investigations. The internal disciplinary case and the criminal one.


    Flynn could also win his case under a recent SCOTUS case but had chosen to take the plea. He might back out of it soon, he hasn’t been sentenced. That sentencing has been delayed in an unusual manner.
     
  21. No difference. The federal government doesn't have the authority to grant or use a warrant in the United States that isn't supported by evidence showing probable cause - FISA warrants included. Congress can't make such a law and courts can't act on it. A FISA warrant requires the court find probable cause that the target of the surveillance is a "foreign power" or an "agent of a foreign power", and that the places at which surveillance is requested is used or will be used by that foreign power or its agent. Probable cause can't be established on the word of an unanimous tip to a newspaper.
     
  22. Here's a motherjones article from 2013 about use of the FIS Courts up to then. Back then the liberals had a more sinister idea of Court than they do now that they are gonna take Trump down using it.

    The percentage of rejections is smaller today that it was then.

  23. The unanimous tip was only to bolster the known source whom had been considered reliable in the past. The FBI failed to tell the court he was no longer “reliable”. But that source was known and had provided proven intel in the past.

    The difference in the FISA warrants is the “two hop” rule. That is if the warrant is against carter page and he talks to Manafort. The FBI can tap Manafort’s communications without getting a new warrant. That’s one hop. Now Manafort talks to another person. That’s the second hop. That’s how they recorded Trump’s conversations without returning to the FISA court for a new warrant. Trump was the second hop.

    Also foreign nationals on American soil have less rights to on a FISA warrant than an American. That is not true for other warrants. Americans and non Americans have the same search warrant rights on other warrants.
