"As Eason removed the handgun from his waistband, the officer fired four rounds, Valdes said."

I guess you'd have to be there to know exactly what happened. Did the perp draw and point the pellet gun at a cop, or did he "remove" it to surrender? Or simply trying to show the cop it's not a real gun?

So... open carrying of an air pistol did not prevent this?

NJ state law, as wrong as it may be, classifies almost anything short of a water gun a firearm. From air(CO2) powered pellet pistols, to a Red Ryder spring air rifle. In NJ he may as well have been carrying a Browning M-2 for what was worth. That's how the police in NJ identify the bag guys / criminals... they are the ones with the guns. I need to get out of this Garden State.

Before I read the story, the first scenario I thought in my mind after reading the title goes something similar to the Philly incident: off-duty cops draws weapon on legally carrying OC to get his ID and when OC sees unidentified pointing a gun, he tries to defend himself only to get shot first.

Turns out it's a typical story about a scumbag in a socialist welfare state with a pellet gun getting shot for committing all kinds of illegal crimes.

in a very high percentage of cases, similar to this, i would side with the LEO. USUALLY, if you follow the instructions from the LEO, you will not get shot. it looks as if the shootee, in this case, was lacking in functioning gray matter, tween the ears.

I remember on the show, 'The first 48' where detectives found this guy DRT with latex gloves on an a gun beside his body. First thing they said was, "I bet he tried to rob someone". And yep, that is what happened.

So this guy with fake gun, ski mask, and other things goes walking down the street. Yea I'd have plugged him to when he went for his fake roscoe.

Remember the first rule of gunfighting. "Have a gun". And it helps if it's a real one.
