"NY woman faces attempted murder charges for throwing molotov cocktail at NYPD van during riots: reports

A New York woman has been charged with four counts of attempted murder after throwing a molotov cocktail at an NYPD van occupied by multiple police officers.

Samantha Sader, 27, of Catskill, additionally faces charges for attempted arson, reckless endangerment, criminal possession of a weapon, and assault, WABC reported. The device reportedly didn't explode and all four officers inside were able to escape.

"Multiple individuals, including the two sisters from upstate, are going to be charged federally (prosecuted by the U.S. Attorney’s Office for the Eastern District of New York) in connection with crimes last night involving Molotov cocktails in two different Brooklyn North precincts," a law enforcement source told Fox News on Saturday.

New York City Police Commissioner Dermot Shea condemned violent acts, saying "it is by the grace of God... that we don't have dead officers today."

Darian Shader, 21, reportedly tried to interfere with her sister's arrest and faces charges for obstruction of justice and resisting arrest.

Yeah you can't use liquor bottles or anything with thick glass. Nothing worse than having a lit Molotov cocktail bounce back at you.

Put snipers on overwatch. Anyone with a Molotov cocktail gets dropped.

I disagree. I think they're going to push for the maximum sentence and make an example out of her, as they should.

They really need to rethink the use of incendiary devices, or anything that could cause the loss of life or limb. Deadly force is justified in prevention of they're use. Used to be at least, 2003-2006 time frame in my experience. Speaking in terms of a soldier deployed in that time frame of course. Good way to get smoked. Really quick.

A shame that that’s even an option, but it’s the way our system is setup.

The officers should have barrel rolled out of the vehicle and shot her point blank

Even in my liberal state, under the law, you are correct. It would be justified, but only to prevent the assault. If the cocktail was already thrown and she ran, it would be a bad shoot.

    https://www.mass.gov/files/documents/2016/08/xm/9260-defenses-self-defense.pdf
"If the defendant (used deadly force, which is force intended or likely to cause death or great bodily harm) (or) (used a dangerous weapon in a manner intended or likely to cause death or great bodily harm), the Commonwealth must prove one of the following three things beyond a reasonable doubt: First, that the defendant did not reasonably and actually believe that he (she) was in immediate danger of great bodily harm or death; or Second, that the defendant did not do everything reasonable in the circumstances to avoid physical combat before resorting to force; or Third, that the defendant used more force to defend himself (herself) than was reasonably necessary in the circumstances."
Police are not required to retreat even when able since they have a duty to act.
