New York’s ‘red flag’ gun-control in effect

    Does the NY law include a section making it a misdemeanor to file a petition for an ex parte gun violence restraining order or a gun violence restraining order issued after notice and a hearing, knowing the information in the petition to be false or with the intent to harass, like the GVRO law in CA?

    Add this to the growing list of reasons I left that suck hole state over 40 years ago.

    I have a class reunion in New York this coming September. I
    would have to drive there. My LTC is good for every state I would travel through except New York. Guess I won’t be going.

    Albany and their cronies can kiss my arse.

    Hopefully. Just remember Executive Order 9066 sent over 65,000 Japanese Americans to prison camps in 1942 without due process.
    They were never charged with a crime either.

    What's it up to 13 states with these laws now? This will pit neighbor against neighbor in this boiling civil war. Hate the conservative gun nut next door, drop a dime. The men with guns will gladly bring out the tactical team armed with "patrol rifles" to take your conservative neighbors "assault rifle". If you thought SWATing was a thing wait until this takes off. How many have been killed by the hero's in LE already?

    Did the people fight it and bring litigation up through the courts into SCOTUS? I don’t know, just wondering if it’s a valid comparison or not.

    The gitmo prisoners are in the same boat. A lot were detained for good reasons but they could not use the information in court due to the Constitution allowing for witnesses to cross examine their accusers

    The Supreme court said it was lawful unless they were obviously loyal. It wasn't one case but two paraphrased in one sentence so there is a lot of subtlety missed.

    The war ended or at least the great threat was gone by then.

    Yes. Korematsu v. United States filed in 1944. The SCOTUS at that time found the internment to be legal. Seems like our government can do whatever it damn well pleases.

    One of the most onerous judgements ever made.

    As I recall, a group of Americans filed a petition with the United States government in 1976. President elect Carter upon being sworn in as president ordered the Justice Department to review Executive Order 9066 for its legality.

    The Justice Department determined that it was a gross abuse of power and in violation of the constitution.

    I wonder (not really) why women would be for this when it would make it so easy to disarm them in the case of a stalker?

    The constitutional protections (in theory) would only protect them if they were citizens.

    Didn’t a jury fund him guilty of several crimes including attempted murder? How in the world is that relevant to what happened to law abiding Japanese-Americans. I’m just not following you.

    I was unfamiliar with this case so I looked it up. Interesting how the President who imprisoned these Japanese-Americans and all but one of the SCOTUS Justices who ruled it was perfectably acceptable....were Democrats. The Democrat Party really is the party of racism and intolerance. Always has been.

    The more I dig into United States history, the more disturbed I become.

    Check out the Sedition Acts of 1917 and 1918 for more gross abuses of power.

    Interesting isn’t it? FDR and Woodrow Wilson were both Democrats. Both passed Executive Orders that violated the constitution.
