I am relative newbie when it comes to guns, got my first one last July together with PTC and all pertinent papers. For 3.5 months or so I have never encountered a problem, until last night that is.

I was coming home from a friend's bday party around 1am when I was stopped by a checkpoint. The cop saw the duffle bag beneath the front passenger seat. Since I had all relevent papers with me I decided to just be honest and tell them I had a gun instead of them forcing me to open it. Well it turns out my PTC was a fake pala.

This was my first being in such a situation so I was nervous as hell. They wanted me to go to the precinct with them, and I have heard of several horror stories about what goes on in the precincts so I did my best not to go. That was to no avail, I called a friend of mine who was a Major in the police force of a different city, he talked to them pero ayaw parin makisama. In the end he just requested that they treat me well nalang, wag pa media, wag muna file ng report, while he makes his way to the precinct. I also called up a friend of mine who had good connections in that city, good thing he came to my aid.

The cops were asking for 50k, since such an amount was impossible for me that time, we were able to negotiate it down to 25k, but that is still a lot of money. But it was a better offer since during the start most of them were just itching to throw me in jail. If that happened I would have spent 3 days in jail since Sunday, Monday, Tuesday are all non working days, so no possiblity for bail. Both my friends urged me to accept the offer, since normally it would take at least 50-100k of grease money. So from 1am to 4am I was in the company of cops who continued to threaten me, I don't know what would have happened if it weren't for both of my friends. The police Major came when the deal was done already, he just escorted me home, since he was the one who referred me to the person who did all my papers, sabi niya he'll just fix things nalang.

For me I am just dismayed at what happened. I paid a lot of money for a phoney document, and frankly what happened last night was a bit traumatic. I just want a form of self defense during these tourblesome times, I was never prepared for all the BS that would accompany having that privelege.

Sorry for the rant, I'm just coming to terms with it all.

    Thank you for sharing Benj.

May I ask how the policemen proved that your PTC is fake?

Thanks for sharing Benj I hope that doesn't happen again. I am also interested to know how did they prove that the PTC was fake. It would be good to know how it could be verified so this event wouldn't happen in the future.

Tsk...tough luck. But you are still quite lucky under the circumstances. If you were caught by the SBMA Police here, things would be a little bit more tricky to get out of.
Did they confiscate your pistol? And what did they specifically pointed out to prove that the papers was fake?

    Thanks for the concern guys.

At first when they were insisting that my PTC was fake I didn't wanna believe them. But they pulled over two other cars that had real PTCs, we compared them and medyo malayo talaga.

First off mine had a purplish heu, where it should be light blue/whitish. Also mine had no holographic logo, dapat ata may logo ng PNP or something. Basically dapat mukhang driver's license yung ptc mo, but mine looked like it was printed on a computer. Tapos laminated pa, they were able to scratch off some portions of the laminate. According to the cops they have encountered this same style of PTC several times before, malamang daw sa recto ginawa.

The paper of my gun was ok, kahit na yung yellow form palang ang nasa akin and wala pa yun card, but the PTC was an obvious forgery. I was asking nga if they could check kung registered ba yung PTC number ko sa database. Sabi nila wala rin magagawa, kahit na registered nga yun, but I still had forged card, sabit parin ako.

They didn't confiscate the gun. They wanted to confiscate the fake PTC but in the end naawa nalang din siguro sila sa akin and they told me they were gonna release it to me para I could show it to the one who issued it to me.

I think may good side narin yung nangyari. At least it happened in a city where I had a friend to back me up with his connections. I'm going to Subic pa tom. with the family. Paano naman kung nahuli ako sa may Subic, or Pampanga or other place on the way there, mas mahirap pa. Hay.....excited pa naman ako subukan yung range sa Subic hehe

I was browsing the DOJ site under PD 1866 an found this:

Any person who shall carry any licensed firearm (of any caliber) outside of his residence without legal authority therefore (6th Par. Sec.1)

    Penalty: Arresto mayor

    Recommended bail: Bail Not Required

Somebody tell me what Arresto Mayor is.

Two reasons why the Philippines is considered as one of the most corrupt country in the world:

    - law-enforcement officers who take bribes
    - civilians who pay them for breaking the law

First and foremost, it is your responsibility to know that your PTC is legit. Ignorance of the law is no excuse....PERIOD!

Whether you were a victim of a scam or not, I could not blame the cops for wanting to throw you in jail. If I were in their shoes, I would too because you could have been the one who made the forgery yourself and tried to pass it for real.

Before I forget, that Major friend of yours may be in on the scam. Think about it!!!!

Not only were you able to buy your liberty, the cops also disposed (by giving it back to you) the evidence against you.

All for 25,000 php which is roughly equal to $450. tsk! tsk! tsk!

    I am so sorry for what our country has become......;1 ;1 ;1 ;1 ;1 ;1

Arresto Mayor is imprisonment of 1 month and 1 day to 6 months. It carries the accessory penalty of suspension of the right to hold (public) office and the right of suffrage during the term of the sentence (Articles 27 and 44, Revised Penal Code).

I'll try to post a pic of the fake PTC, it's not with me right now, maybe I can get it within the next few days. Actually we are thinking of suing, pero mukhang wala ring mapupuntahan yun, so baka all we will do nalang is to ask person to give us a real PTC without having to add any more money. The 25K that I paid is lost, I've accepted that already.

I don't think I should post the name of the person yet, we'll see what happens nalang in the next few days.

BTW, I just realized this might not be a good topic to discuss here in glocktalk, mods if you think is inappropriate please feel free to lock or delete the thread. I didn't mean to cause any inconvenience.

That was a horrible experience and thanks for sharing it with us. Maybe it is just right to give us your source so Phil BOGs would be aware. Who knows some might also have the same source. That's why you should always ask for the ORIGINAL RECEIPT everytime you process your PTC. Don't settle for just the card.

What was the LEOs' probable cause to search your bag? Calling BOG Legal Minds, can authorities search any vehicle any time without PC?

Only during check points the LEO can check any vehicle. However, their search is only limited to what is in plain sight. They can't force you to open the glove compartment, trunk or any bags inside the vehicle. But it seems that a lot of local LEO not know this. Kaya case dismissed...

ang mangyari cguro nyan mga sir kung e refuse mo sila isama ka nila sa precinto tapos they will hold you for as long as they can legally hold you and during this time they will try to get a warrant to search your vehicle, once thay've got that warrant patay ka!!!!!! they're gonna ask for more than 25k.....cguro 25x3 na yan;T
