I certainly understand why an employee would refuse what he thought might be a straw purchase. I wonder if her size led him to believe it might be a straw purchase or if he guessed that she might get hurt if she used the gun and then used the straw purchase as an excuse. He might not be aware that a petite woman could actually be fine with a shotgun and maybe was concerned that if she got hurt there might be liability.

Could have very well looked like a straw purchase. Small woman asks to see a weapon with a guy standing nearby.

If gun dealers are going to be held responsible for a straw purchase, they will sometimes get it wrong trying to be cautious. Get the law changed if you don't like it.

I agree. With the Obama admin controlling BATFEces, every FFL holder is a potential target.

This is still America. I can't believe you people who have no problem with this. This culture of suspicion that our government has been pushing is stupid.:wow:

Yes. He is an idiot to impose his opinions and poor judgment on others.

They were family and legal. I have gifted many in my family with guns, legally.

He didn't know they were family and legal. They could have just as easily been family and illegal. If he is legally responsible for making sure a straw purchase doesn't happen, what else can he do besides use his best judgement?

I think if someone has the proper ID and passes a background check they should be able to purchase the weapon they want. The CYA, at all cost without reason, attitude is what is wrong with our country. There are not scary monsters around every corner.

Sounds like the guy was out of line, but I support a their right to refuse service to anyone that want.

Does that include black people? How about Jewish people? Maybe just the homosexuals?

    From the article:
"Not only that, but primarily based on her size, the employee allegedly threatened to call the FBI and asserted that she was really buying the gun for someone else."

This was a lie, and his opinion, not a fact.

The store did not have to sell her anything if they didn't want to, but that was not the claim made.

The woman was going to buy it for herself (reference the article) and was legally allowed to. No Government forms had found any reason to reject her purchase.

You bet. If you want to only sell to middle aged, fat white guys, and your business can survive, more power to you.

Yes, this is America, where merchants can refuse service to people. Last I checked neither Wal-Mart nor the clerk is an agent of the government so I'm not sure what that has to do with anything.

Feel free to open your own gun store. Then you can fix this travesty.

Other than that, what is your solution?

Yep. I bet they wont buy a firearm from Wal-Mart again. None of us have to either. Not sure what business it is of mine what a clerk at Wal-Mart would or wouldn't sell to some woman I've never met. I wasn't there, either.

I don't fault him for suggesting a gun he believes may be a better fit for her, but he should have sold her the damn gun when she insisted that is the one she wanted. Hell, I'd even give him that he should make sure to mention their "no returns or exchanges" policy....

But to suggest illegal activity without any evidence? Nope.

If the clerk really thought the gun was for the husband, why not ask him to fill out the 4473?
