Model release needed???

    If I take candid shots of folks in public places and want to publish them, do I need model releases?

    When are releases required?

    Editorial no, advertising yes. I shoot stuff for stock all the time. If you can't say where it will be sold you either need a release or unidentiable subject.
    I think big wide street scenes or other gobs of folks would be safe. Tight stuff you're on shakey ground w/o a release. I've lost sales because I didn't have a release for cool press stuff I'd done. Owned the copyright but no release.
    Best bet is CYA.

    As a corollary question, could I sell prints of street photos? That is, an identifiable person,but no advertising intent, just a straight print sale. Just curious if anyone knows.

    Do a search on photo.net pertaining to this question it comes up more than once a month, but I believe harless has it right.

    I do model rls on all models that I shot and specially any under 18yrs old. Can't be to carefull now adays, but if take a general photo ( street photo ) I don't nessary get model release from everybody in the background.
