I agree with this ruling. The recycling grant was otherwise open to all entities and excluding some solely on the basis that they were religious in nature was unconstitutional. The ruling cites a 1st Amendment violation, but I would think that it would also be a violation of the 14th's equal protection clause.

The court is also going to hear a case where a Christian baker declined to make a cake for a gay wedding. That will be interesting, especially if Kennedy retires as rumored and is replaced by a Trump appointee.

Seems like an appropriate decision to me. After all, you wouldn't deny a church the services of police, even though they don't pay their share of taxes. The only surprise in the case is that it came from Missouri. Why didn't their judges get it right? California would have gotten it right.

The Supreme Court also decided to hear the case of the Colorado cake baker.

Knowing why this is different than the Baker case would really help. It's been explained.

Yes, and I've rejected your explanation. I have a feeling the SCOTUS will be explaining it differently to you.

The 14th amendment argument was brought up by the Church and in my mind is the key to this case as it has much more to do with equal protection than it does free exercise of religion.

I have not read the ruling to see how much focus the SCotUS put on either clause.

It won't change the differentiation you don't want to grasp. And if you get your wish....Muslims will love it.

Maybe just maybe they could stop giving tax money away to anyone to be spent to improve private property. That would be even better....

The state has an interest in furthering education, no matter who owns the delivery system.

I remember back when the civil rights laws came around in the 1960's. There were people saying that their religion called for segregation. Religion wasn't a legitimate excuse back then, and I don't think that has changed.
