Just Got Raped

    My family and I were coming back from a vacation in Mammoth and I was pulling a 4x6 utility trailer with some camping gear behind our vehicle and were stopped for speeding. I was going the speed limit for automobiles, but apparently (I didn't check the states regulations regarding towing) anything with three or more axles has to travel at 55mph vs. 70mph. This trailer is one that I can lift off of the ground completely unloaded and with the tongue, trails maybe 9 to 10 feet behind my vehicle. If you have ever traveled the California Interstate, no one does the speed limit, including tractor trailers, RV'ers, boat haulers, etc. I would have been a road hazard had I done the 55mph and having driven commercial hauling triples, I was more than qualified to tow.
    Needless to say, I am major teed-off because I am looking at roughly a $350 to $400 fine. I understand, from having talked to others with similar experiences, that they are targeting small trailer and RV haulers for the revenue. They are one of a handful of states west of the Mississippi that have a reduced speed limit for trailer haulers including Hawaii, Alaska, and California. I understand safety issues of towing but I feel this law is unreasonable.
    Am I just being a big baby and deserve what I got or is this unfair? Comments

    It’s unfair. Being in the Carson City area I avoid taking the boat to any California lakes due to this reason and the higher launch fee’s. I can launch in Tahoe for the same price as June Lake down by Mammoth.

    Sounds like you could have got off with a warning, but the law is there, so your pretty much on the hook for it. I know it's aggravating because truckers ignore it and seem to rarely get pulled over for it.

    I dont know brother. Here in SC we have big rigs that drive 70 mph (legally) and over (illegally). I travel a good bit and I see 'em pulled over but not often. They swing those things around like souped up Honda Civics and scare the piss out of me sometimes. I think you pulling a trailer at 70 mph is plenty safe by comparison but you are in the Peoples Republic of CA so reality and common sense are largely lacking.

    Ralph, you have encapsulated in your post many of the arguments I hear every day in court.
    And you are certainly entitled to your opinion.

    Were you in Texas, my response would be something like this:
    "I understand how you feel. I drive, too. But I don't make the laws. The people you elect make the laws. If you choose to break the law, my job is simply to see that you pay the legislatively mandated fee for making that choice. You are not a bad person, nor am I. This is how the system in our state works.
    "Of course, you can change it, but you do that at the polls, not in the courtroom."

    If it's like FL, next time have one or more family members dress like an illegal and have them hold a rake and a leaf blower.
    They could probably sit back there unrestrained at 90 mph with their feet hanging over the side and no one will stop you.

    Sorry you got raped. You can't blame the cop for enforcing the laws though.

    As a teacher, I deal with similar sentiments: "Why are you writing me up? Everyone is doing it too!" Me reply always: "You were the one closest to me, next time make sure you're not."

    The legal system makes it painful so you won't do it again. Own it, learn from the experience, and move forward. Most of us have been there.
