    I got served, yo! :rofl:

    20 years in business, never got served to provide records on a client or former client.

    That was funny. The moment of "oh crap, who is suing me" then seeing the names on the subpoena and realizing this had nothing to do with me. I feel like Raymond K. Hessel. My coffee tastes better, the clouds look prettier.

    Client was over a decade ago. Hoping my nicely worded letter to the atty in question will preclude me needing to go to his office and say "I don't recall" 45 times. (I'll be like Reagan at the Iran/Contra hearings. LOL)

    Worst was: My office door opened and the guy was wearing blue - I thought my iPhone 5 was here. :rofl:

    I'd run it by my own lawyer who is on retainer if I were you first, just so I didn't get pounded in the same sentence, or paragraph.

    I managed their money for some time in the 90's. Now the heirs are suing eachother for more money. They weren't a client 10 years ago. How would I have ANY info of value??? (Records are purged at the 5 yr mark per the SEC. Well OPTIONAL at the 5 year mark, but living in MA with the stupid privacy act here, it's safer to purge as soon as legal.)

    It's a subpoena to produce records. I can avoid appearing if I produce. The letter to them states: I ain't got nuttin to produce.

    Run it past a lawyer and give them what they want. Also have the lawyer see who can you go after for fees and expenses. Could be the courts, could be the plaintiff.


    My uncle got served to produce records. We had gas stations and at one time they apparently had a charge card with us. We figured they were using their delivery trucks for something bad.

    We had a couple of hundred commercial clients with charge cards but only about 20 were regular customers. We closed all the charge card accounts years earlier when everyone went to credit cards. The courts freaked out because no one remembered who they were.

    Because we had no records that far back the courts tried to implicate us but never told us what for.

    contact an attorney, who may advise to file an objection or motion to quash the subpoena especially if it will be burdensome due to quality, volume, difficulty in producing the requested documents. May be able to claim these records are confidential as client privileged.

    He's already purged the documents after the legally required retention period. They're about 5 years too late to get any docs from him.

    This is why I keep harping on staying on the state mandated retention schedule at work but nobody listens to me.

    Typically, you may be able to get certain reasonable costs paid by the requesting party. From there, they may or may not be able to recover from the other side if they win.
