In the unfortunate event of self defense and the only gun available to you is a hunting rifle or shotgun with a hunting round like sabot or slug, will there be an issue with regards to your defense in court?

Aside from overpenetration, what are the other potential issues?

When you need a gun and the one you use is the only one available, it's a pretty good defense against having made a negligent choice in firearms.

As you noted, overpenetration is the big concern. So, of course, is hearing damage when it is fired in enclosed spaces. Keeping active muffs handy with the gun can of course help with the latter. Buying some buckshot for your hunting shotgun for home defense use, or some Hornady TAP for your .308 deer rifle, can help mitigate overpenetration issues.
