how to find a will / trust ?

    As some of you probably remember my grandfather died a few months ago,

    We are needing to find out if he left a will or trust or something,

    Is there any way to go about finding if he left one ?

    we dont know if he had a lawyer or anything like that,

    this was in California, and we live in Arizona,

    Wills don't have to be recorded but they might be. Try the courthouse in the county where he lived. Search his house. Next of kin or executor can go to the bank he used and see if he had safe deposit box. Good luck.

    The lawyer who drafted the instrument will keep an executed second original. So, while you are searching the house, look for evidence of who the lawyer might be.

    If that doesn't work, place this ad in the back of the state bar journal: "Relatives are looking for the drafter of the will of Joe M. Blow, of Long Beach, CA, who died on February 18, 2010, at age 84. Please call 405-557-9890" Those little ads are always in the bar journals.

    When my father passed away last year, we never found a will. Could not locate a lawyer who had drawn one up, either. My aunt (his sister) did take over the house for a few days, and removed paperwork - unfortunately, we have no idea what, because she refuses to tell us. (we did get her out of the house, and get it sold, thanks to the fact that without a will, we are his heirs..... and the fact that my grandmother did what he stated to her, prior to his death).

    there is a lot of problems in our case,

    Robert (grandfather) was married to my grandmother,

    he lived in California for many reasons, and she lives in arizona,

    He died mid last year, we didn't find out till end of last year,

    we were never notified that he died, we found out when x-mas cards came back to sender, tried calling, and number was disconnected,

    we have a feeling that his Realtor came in and stole everything,

    but we have no way of finding out as we weren't even notified he died and had to find out on our own,

    ugly things have happened here ..

    they said that grandma was divorced / dead not sure which, but whatever it was she was not notified and we have no real information ..

    Based on my experience, here's what I'd do:

    Call the probate division/court in the county he lived (died) in. I *think* if any legal instrument was executed they would have it recorded there. (Did I mention I'm NOT a lawyer?) :wavey:

    What happened to me was that my grandmothers's sister-in law (my great aunt) passed away and about a year later I got a phone call from some probate division in Freeport, Illinios (I live in Tampa). The said they were settling her estate and they had a check for me.
