How has Glock Talk missed: Homeowner Shoots Alleged Burglar, Goes Back to Bed Before Calling Cops

    This story has been out for a few days now, but I can't find a thread on it. I'm surprised because it has Glock Talk written all over it and it has been national news since

    Homeowner Shoots Alleged Burglar, Goes Back to Bed Before Calling Cops

    The papers have been playing it up as if the shooter was arrested for going back to bed and leaving the burglar to die. I doubt Texas has any legal requirement to do anything different. More likely, he is in jail because the police think the shot that killed him was the second one:

    "The homeowner then 'fired another shot ‘into the night’ after the man dropped the pickax and fled toward the park behind his home.'”

    That could explain the jail thing.

    Looking at a longer version of the story, looks like I was right:

    It was only two hours later, when he woke up again, that he saw what he thought was a black bag from his window and went to take a look. When he got near he saw that it wasn’t a bag but a man who was lying facedown.

    What Happened After He Discovered The Body?

    James then immediately got his wife to call an attorney even before calling 911. When he called 911, he refused to answer the dispatcher’s questions properly and kept insisting that he was a victim of a crime. He also repeated that medical assistance was needed. The police had arrived to find the dead man with a gunshot wound to the back of the neck. It was determined that the man had been dead for several hours. Mayer was later arrested and has been jailed with a bail of $150,000.


    72-Year-Old Man Shot A Burglar Before Going Back To Sleep, But What Happened After He Woke Up Will Shock You

    Story 1: dropped the pickaxe and ran away
    +
    Story 2: fatal wound to the back of the neck
    = Somebody going to prison

    If the body was lying there for 2 hours without anybody noticing, I'd have driven him off in the woods somewhere and dug a hole. On the other hand, in Texas this was closer to legal than it would have been in Kentucky.

    It happened in Texas... so no problem?

    Remember the Joe Horn incident? Horn shot and killed two burglars who robbed his neighbors house and were running away. He was cleared by a grand jury.

    Sounds like a lot of mistakes. Wonder what the attorney suggested he do?

    I have advised a neighbor to call the Sheriff.... Instead he grabbed a shotgun, got another neighbor to bring his shotgun..... People given good advice still do stupid crap.

    Hope he shuts up before he really gets in trouble.

    He probably would have been ok here in TX had he called 911 and reported the burglary/theft attempt and stated he popped some rounds off. He seemed to pick up his casings too. I guess he did not wanna litter either.

    I recall a similar story from several years ago. In that case, the guy shot multiple intruders and then went back to sleep because he didn’t want to wake the local deputy. I think what got him was admitting that he wounded one or more and then walked over to deliver the “kill shot.” I can’t find the story, just links to this one and the Guyger murder.
