House votes to make short-barreled weapons legal
    Posted: Jan 27, 2010 1:16 PM EST
MONTGOMERY, Ala. (AP) - The Alabama House has passed a bill that would make it legal to own a short-barreled shotgun or rifle if you get a federal permit for the weapon.

The House voted 83-7 Tuesday for the bill by Republican Rep. Jeremy Oden of Cullman. Opponents included several former law enforcement officers who argued the bill would endanger the lives of police officers.

Oden argued that the weapons are used by farmers to kill rodents and other pests because they are easy to carry.

The bill was amended to require a federal license to own a short-barreled rifle or shotgun. Oden said he would try to get the amendment removed in the Senate or rewrite the bill and bring it back up in the House.

Someone familiar with Alabama laws please chime in--does this mean that even with the ATF stamp/paperwork, you (at present) cannot have an SBR in Alabama?

Yeah. There are a number of states where this or full auto or explosives are illegal even with the federal paperwork.

Drat! I was kinda hoping it was the Congressional House and they were removing SBS/SBR from the NFA, you know, like they should have done before it passed.

So, Oden wants the bill to pass in such a way as to override Federal law?!?!?

    :wow::wow::wow::wow::wow:

Well, that's probably different than a lot of places, then. Most places, I took it that NFA items were totally forbidden. I wonder why they split it like that?

    I love it.

There are more and more state legislatures that are passing laws to challenge the fedgov's role in our lives.

Baby steps, sure, but I like it nonetheless.

That is correct. Right now only LEOs can possess them and even then the weapons must be owned by their agency.

But don't get too excited about this bill just yet. There has already been one amendment made to the bill and in Alabama that usually means a long drawn-out death to the bill. And the thing hasn't even gotten to the senate yet.

It would not overide Federal Law. State law and federal law are separate issues and both must be complied with.

I have often asked this question. I am yet to have someone explain why. Go figure. It IS Alabama after all.

Well, I mean in the sense that it sounds like Oden wants the bill passed unamended, and the amendment is that the state law comply with Federal law.

Since the amendment is the only part saying {from the sound of it} that they expect their citizens to get a green stamp.

Can't have a suppressor in MA. We CAN own SBR's tho. ???? Too many spy movies seen by Legislators years ago, I guess. (We also can't carry throwing stars, nunchucks, and other "scary" weapons that no one carries.)
