FL: 'Stand Your Ground' civil suit is a surprise

    TAMPA - Casey Landes attacked Charles Podany in an alcohol-fueled rage, authorities say, chasing Podany as he tried to bicycle away, knocking him to the ground and beating him as he sought to crawl away.
    A judge ruled in September that Podany, 49, was justified in shooting and killing the 24-year-old Landes. Prosecutors did not appeal the decision.
    But Landes' family is now suing Podany, claiming Landes was a victim of "wrongful death" and that Podany was a danger to the Bay Hills Village Mobile Home Park where Podany lives and where Landes was shot.
    The lawsuit has left some baffled.

    Don't know anything about this case, or much about the "Stand Your Ground" law, but this seems a little odd. IIRC the law isn't too old, so maybe in hindsight this civil suit will just end up being another case law to strengthen the law. Don't know.

    No surprise at all, Shysters are everywhere. The law is clear. The shoot was ruled good, so once this suits gets to a judge, he'll squash it as the laws requires. According to the law he must also award court costs, attorney fess, etc to Podany to 'defend' against this suit.

    That's doubly odd, usually there are strict IQ requirements from homeowners associations of trailer parks to keep out the dummies. The people suing must have somehow snuck through the cracks... The lawyer that took their case must live there too.

    Hope the shooter hires a high priced attorney as long as the plaintiff will have to pay for it...

    This shouldn't go far in court. I hope Mr. Podany's attorney is extremely expen$ive when it comes time for the plaintiff to pay up.

    The stand your ground law does not prohibit a suit being filed.

    It prevents it from proceeding beyond that point.

    Sounds a lot like what happened to OJ............... Was justice finally served or was a bad precedent set?
