Denied Handgun Purchase

    I have a friend that was recently denied purchasing a handgun here in Tennessee. He appealed and received a form that said he was disqualified for firearms by the FBI in their database.

    He says he doesn't know why he has been denied by the FBI and has purchased a rifle in the past two years. He is really concerned about this situation.

    Do any of you guys know what might be going on or what some of the reasons someone can be denied firearm purchase by the FBI?

    It could be any number of things. I have seen it be anything from someone with a similar name being prohibited, an order of protection, a soc sec number similar to another, etc. I always thought that when you appealed they had to disclose why you were denied.

    The FBI runs the NICS (national instant check system) that does the background check when you purchase a firearm from a dealer in a State that calls into NICS instead of a State system.

    There are many reasons why a person can be denied.

    Criminal history shows they are a convicted felon, convicted of misdemeanor domestic violence, fugitive, or mental.

    If your friend has several arrests for misdemeanor drug charges, the FBI will declare him to be an unlawful user of drugs and deny him for that.

    It could be your friend has a common name and the criminal history check is linking him to someone else that is one of the above.

    Have your friend go the store where he was denied. They should have a pamphlet there that will tell him how to challenge the FBI finding.

    Unfortunately, he will have to everything by mail, as they don't take phone calls.

    He will need the Nics number from the form.
    The appeal form.
    And a letter to the Bureau.

    He may need a lawyer down the road.

    More then likely, your friend has more of a past then you might know? Hopefully its something simple?

    If your friend has a copy of the form he filled-out, see if all the numbers and such are accurate.

    I was denied once on a rifle purchase when I lived in California. It turned out my car's registration had expired two days earlier and I forgot to renew it. I took care of it and then I was cleared to buy the rifle.

    I was denied once, when its cleared they send you a certificate and tell you the reason for the denial. But it took around 120 days.

    Really it is a friend, I bought my MIL a shogun last week no problems.

    Thanks for the suggestions it will give him a place to start.

    That recently happened to a friend of mine at work. He filed and appeal and it checked out okay. He had to take the letter from CBI with him back to the store where he had originally tried to make the purchase. If I remember correctly, it didn't more than a week or two.

    Does bad credit/debt affect this too maybe, and unpaid/pending vehicle tickets.

    I have been delayed twice. both times it was cleared up in about an hour. Most of the time I have no problem at all and belive that there is someone with a similar name who cannot legally purchase a gun.

    Responding to what the person said happened to them in California. Are you saying it did not happen and he is lying about it?
