dealer question

    I have a few question for you dealers.
    1-When someone buys a gun on a forum or gun auction do you charge them sales tax?
    2-Do you buy from a NON FFL? or take shipments form non FFL sales?
    3-do you check if a gun is stolen? if so how?
    4-How do you do trades? I see on the forum that people will trade x for y.

    1. You don't have to charge sales unless you are a business with a physical presence in the same state as the buyer. (not counting some of the new internet sales tax but that is still just businesses)

    2. You can buy from a non-FFL but it must be shipped to an FFL for you to pick up, unless it is FTF.

    3. You can get the serial number from the seller and take it to your local PD and ask them to run it for you. Most will.

    4. Hopefully they have references or just blind faith. Up to you to have trust in who you are buying from, that is why a lot of people want FTF.

    In my state, you are supposed to pay the sales tax for out of state purchases with your annual tax return (it's a scam where they call the sales tax for things bought in other states "use tax"). Nobody really pays it. However, you don't have to pay sales tax to the transferring dealer because he isn't selling you anything - he is just charging to complete a federal paperwork requirement that is separate from the actual business transaction.
