I say give the commiecrats every consideration that they gave us ....
I live in the 9th Circuit. There is a problem which I will describe.
First, I have to make it clear that I don't have a political axe to grind. I believe it was wrong for the Senate to deny Mr. Obama's nominee for the Supreme Court a hearing on his qualifications and a straight up and down vote on confirmation. The Constitution says confirmation and I don't believe it was intended to encourage political delays. There were not Republicans and Democrats in the US when the constitution was created.
Politically, this is the way it works. Each state has two senators. In the past each senator had the political right to "black ball" a candidate for judicial office who was a resident of the state. Moreover, the senior senator would come up with three names and the then president with three names and it would be seen if the lists overlapped.
Some people like the gag: "justice delayed is justice denied." Other people appreciate that not funding and having judges in place makes life/business a lot more difficult.
Ok. This is what it is like for a potential nominee. He or she is expected to give up usually a lucrative private practice or the familiar surroundings of an existing employment situation. Then he or she goes through a waiting process of sometimes a couple of years before getting a decision. Yep, you go to a job interview and expect a response within a couple of weeks. This is different. So qualified people will not accept a nomination or will resign from consideration and find a different form of public service.
The vacancies on the 9th Circuit are controlled by Democratic senators. They will not give an inch on considerations. They don't care whether the vacancies cause problems for litigants or make the dispute resolution process more difficult. It isn't even a matter of political ideology. All of them are multi-millionaires. They aren't penniless socialists. Their thoughts relate to expressions of power. Trump has picked the low hanging fruit on appointments. He will not be successful in appointing ideological conservatives to the 9th Circuit.
I am aware that the 9th Circuit gets reversed more frequently than other circuits. Nonetheless, some of the former 9th Circuit liberals have contributed greatly to society.
I expect a lot of negative comments, but I have expressed the reality.
These courts make more major decisions than the Supreme Court and they have a lot to do with what the Supreme Court sees and decides. Glad the left is too busy protesting Trump's tweets and burning flags to notice.
I don't disagree with anything you posted, but the reality is that everything has become political. The fact that "my side" is in control does not give me much comfort in the way our government is run. The founders, in their wildest dreams (nightmares) could never imagine the scene that plays out in Washington today. Sadly, I don't see things changing anytime soon. The rhetoric, the back stabbing, the conspiring just seem to get worse. No one is out for the good of the country, they're all in it for themselves.
