    This is what you rely on for your claim that the Constitution permits the President to declare martial law. There is a clue in that very passage that your reliance on this section of the Constitution is wrong. Hint: Article 1 does not deal with Executive power.

    That's a gross misstatement of the Act at least how it exists today. The power the President has based on the Act isn't "granted to him by the Constitution," but by Congress. The Act is found at 10 USC 251-255. It says that the President can aid the states when requested by the states:

    Whenever there is an insurrection in any State against its government, the President may, upon the request of its legislature or of its governor if the legislature cannot be convened, call into Federal service such of the militia of the other States, in the number requested by that State, and use such of the armed forces, as he considers necessary to suppress the insurrection.​

    10 USC 251. Section 253 allows the President to step in to suppress "insurrection" without an invitation from the state in very limited circumstances. But there is very little guidance as to the exact nature of those circumstances, and even if the President exercises that authority, it's not really fair to call it martial law. In fact, the very reason to step in is to enforce the execution of state and federal laws, not supplant them.

    Most of these instances are a state-level official declaring martial law. An exception is the War of 1812.

    In sum, you grossly misunderstand the President's power and authority to declare martial law and your own sources. The President's power, if any, to declare martial law is far more limited than what you claim.

    In other words, he's talking tough but not actually doing anything significant.

    Kind of like how he's draining the swamp. How's that coming along?

    Kind of like his executive order to stop immigration, which did the exact opposite.


    The speech was only intended to con the most gullible members of the base into thinking that he is "owning the libs." :animlol:

    He can do that without declaring martial law. One or two federal LEOs or locals to make an arrest with the assistance of a platoon of military guys. It’s been done before.

    But the one or two local guys are what make it legal in your example. Got to be used in a "support role"... even if it is 50 SEALS with Deputy Barney Fife leading the charge.

    They can physically hold people back as the LEO makes an arrest . They can detain someone for that LEO and transport the prisoner. It’s been done before

    Keep context in mind - the other proposal from this thread (which is what I was responding to) was using tanks and Apache helicopters.

    I understand.
    Just proper shield , barrier , arrest teams with proper supervision will calm it down. Want to calm it down, pick the Antifa guys who are violent in the crowd and go for them first. They planned this, organized it, and coordinate with each other. Explain to protestors that Antifa makes it look like they are doing it and let them do a little policing themselves. It will simmer down.
