In my state (West Virginia) a person who has a CCW permit is not required by state law to declare that they are armed when approached by law enforcement. Having said this, on the one occasion in which I encountered law enforcement (I was pulled over for speeding) I immediately declared my armed status and only received a warning.

Maybe it's the ex Federal agent in me but the last thing I ever want is for a cop to see my gun and misinerpret my actions as anything other than reaching for my wallet.
I assume Ohio has the requirement to inform LEO on official contact.

If so it sounds like he violated the law and I assume arresting someone is standard for the misdemeanor offense in this location.

The rest of the story seems pretty sensationalized. He had a vest. I assume that is legal. He had a picture that contained children lots of people probably have pictures of children. I assume they where clothed and such.

Not sure what this is about.

Is this two separate charges? I follow the first one but not sure what crime is "physical control of a motor vehicle"
Sounds more like bad blood between the former councilman and the PD. The officer stated he recognized Flores when he approached him. PD got a little payback I think.

Ohio is in fact a duty to immediately inform state. You are required to speak first or interrupt the LEO with the news that you are armed and have a CCW license.
It's true. In Ohio we're required to inform the officer that we are armed. I know for a fact that at least a few officers have gone so far as to have given some citizens grief for not volunteering the fact that they have a CCW even when the citizen wasn't actually carrying/ in possession of their weapon.

Poor guy... should move to AZ... half the time the cops don't even care I have a gun after I've voluntarily informed them.

I took that to mean that was the outcome of the prostitution sting he got his stinger caught in... not related to the current case.

Not sure, maybe Ohio wants to encourage physical fitness and is trying to get people to solicit prostitutes on foot instead of in cars? :tongueout::rofl:

Find a nice lawyer with fangs. Point him in the direction of the little police officer. Make sure that that little police man has to buy Tums by the case. He will learn a little lesson about taking advantage of his position to attack someone he doesn't like. Even if the suit is lost... damage him financially. He can consider the cost his tuition in the school of hard knocks.
wow, the comments are interested.

but what i find interesting is the fact that the police didn't throw him to the ground or shoot him when they accidently saw his undeclared weapon peeking. you know....the one that most everyone here is afraid will get them killed or a gun stuck in their face if an undeclared bulge or a barrel or holster or other indication of a gun turns up. i knew it was all overblown but still, here's what i believe: if you are the right person, you'll be fine. if you're the wrong person, you might get your head blow off....over the undeclared pistol. you know who you are, so declare appropriately. :) in the meantime, this story is my link to the next person who says for sure you will eat pavement if you don't declare and the gun peeks, i have a real life example where that isn't always true. ;)

in a state where you must declare, the police have every right to react strongly to those that do not, after all, you're probably a criminal. in my state where you don't have to declare, the police know it is entirely possible for a law-abiding citizen to not declare a concealed weapon that might peek out, so they would be remiss if they reacted strongly without any other indications. not the best position for police to be in so i always declare when it is likely the police will come into contact with my weapon.

Me state also requires to inform leo,me got pulled over last week at 0230.Leo said you rolled thru the stop sign,didn't signal and pulled wide in your turn.I said yes sir I did sorry 'bout dat and informed him I had me license and me pistol on me.He ran me stuff on his fancy computer and let me go wit a verbal warning.See if'n you ain't a **** sometimes the nice policemens will cut ye' a break.

Not informing the police when you're being questioned or stopped is ignorant. Maybe he learned something.
so in the time of a minute of interaction with the police, he was charge with failure to notify :wow:
