I have had a company contact me wanting to buy a pic of mine they found in a local magazine. To be honest, I am not too sure how to proceed. Obviously I want to get as much as possible for the pic but how do I know what is fair?

If sold, it will most likely will be used internationally

I prefer not to sell it outright, only to license it but I would consider selling, depending on their terms.

    How do I proceed?

    Where will this run?
How many times will it be used?
What forms of media will it appear in? (print, web, ads, billboards, magazines)
If you lease it, will it be one time, repeating, for reprint?
What countries will it run in?
    More than one?

Presently, on multiple continents and most likely they are going to expand.

They want it indefinately. It will be used in all of the following, plus product pacakaging/POS materials.

They prefer to buy it outright.

I used to shoot aerial shots from my Cessna 172 when I owned it with a Nikon SLR, I would take shots of beautiful landscapes, downtown Detroit, old Tiger stadium and give them to friends…I was contacted by a bank here that had seen some of my shots of the Kmart headquarters and asked if I would take some photos of there building…

    I charged them a $1,250 for a poster size photo…

What you have is a repetitive use photo and I assume negative? You could probably get substantially more for it…Try to find out who does their ad work and see if you can get someone in the know there…Or if you are going big time get an agent...

    Good work and good luck!

Their add work is done by their own designers, who also happen to do most of the pics. Somebody just happened to see mine and the rest is history...

    I use digital ONLY

This seems to be a rather fairytale story. Of course, nobody knows what things really costs in fairtales!

    misskitty,

I've sold two pics for next to nothing and wish I had done it differently.

See if they will go for exclusive rights to use your photo for a set period of time, usually a year with an option to renew. Then the rights to the photo revert back to you after that time period.

Ultimately even the best photograph in the world gets stale in advertising and they will want something fresh. At that point you would have the opportunity to rent it out again to someone else if you go this route.

If they truly want to buy it outright it's most likely because you have a real winner. :) Don't sell yourself short. Some photos can go for thousands of dollars depending on their use.

Check out a book called Photographers Market also.

    Congratulations and good luck.

It's not up to them to make an offer.

It is up to MissKitty to tell them what the cost is based on the terms that they would want. From there the negotiations take place.

What MissKitty should ask for is based on multiple things:

-Is this licensing or a sale? If they want the actual image, and to then own the copyright, they better be willing to pay for that ($$$$), most companies won't.

-If it is licensing, then some factors will include: time of use, whether or not the they will have exlusive rights within a certain time frame or market, circulation numbers of the ad the image is used in, as well as the size of the ad/image.

It sounds like they want to purchase the image (copyright), so the question becomes if they know what the actual value of copyright is? It might cost them 10X as much to purchase the actual copyright, rather than just licensing the image.

    My suggestion would be to:

First, head over to http://www.editorialphoto.com/ and look at some of the resources there.

Second, I would try to talk the company into licensing the image for a period of a few years (3-5) for specific usage, that way in 3-5 years, when it is time to renegotiate, you can still continue to make money from this image.

    Taking photos is fun.

    Getting published is more fun.

    Getting paid is even better.

Getting paid well, that is heaven.

I know that she needs to give them a price. Most of the time I've sold images they have offered me a price and I counter with mine. I also know she needs to get off the pot and make a deal before they go to someone else.

    Negoiations are underway.

It took them a couple months to track me down, they can give me a couple days to come up with a price.

Nobody is on the pot, sir.

Must be a very nice image for them to spend that much time to track you down.

That also means the image is worth quite a bit to them if they spent that much time.

    Good luck with the negotiations.

You can't show it until done negotiating? I don't know much about that kinda stuff I just wanted to see what a photo worth money looked like. :)

If she sells it, she may not have the right to post it here anymore. So hurry up and post it already. :)
