2 coworkers, a wife and a shooting, is it SD?

    So as we have the story now 2 guys work togather, one starts messing with the others wife. The single guy stops at a store after work and the married man follows him and catches him still in his truck and starts beating him in the head with his fist. The single guy that's getting beat reaches for his .38 and fires one shot to the chest. He immediately calls 911 and renders aid till the chopper gets there to fly the guy out. We have conflicting reports that the guy dies and that he's in stable condition all in one article in this mornings paper. So far no charges at all. This is in VA and he's not uninvolved with the situation like VA laws mention for it to be SD. Would you still not have a right to defend yourself even if your not an innocent party to the event? Just not sure how this one will play out.

    One problem with VA, is it's laws.

    No Castle Doctrine, and regardless of who actually starts a physical altercation, who swings first, who starts the violence, the other person can be found to be "part of the problem" and be in serious trouble.

    And you have a duty to retreat before you can use deadly force to defend yourself.

    Christ, VA is messed up. Basically, there's no clear laws, just muddled horse****.

    While I don't condone cheating whatsoever, no spouse is worth your freedom and you do not have the right to attack someone else with intent to cause serious bodily harm without repercussions. Just move on..... document it, preferably with a PI, own her in court and let her be someone elses problem.

    The cheating turd might have felt his life is in danger. I am most certain he did seeing he was romping with the guys wife. Actions have consequences.

    I am sure the prosecutor will have to sift through all of this trailer park drama and could charge both men.

    Also if you are cheating and getting your ass kicked, be a man and fight back with fists and take your beating like a man... you should have expected this. Don't mess with another man's: dog, truck, firearms, woman ( in that order :cowboy:)

    Or better yet, just take the richly deserved ass whoppin' like a man.

    The last physical altercation I was involved in was when I was 20, and got my butt kicked, which even at the time in my intoxicated state knew was entirely my fault. I had a Charter Arms Bulldog in an ankle holster and a Buck folding knife on my belt, at no time did I ever consider reaching for either one.

    And yes, women were at the root of it, specifically his sister and girlfriend. He was totally in the right for pasting me.

    Probably justified, but agree he should have taken the whupping, for the stooping.

    The shooter was being assaulted without provoking the attack at that moment. If I'm on the jury, based on only the info in the OP, I say he's justified.

    The "event" in this case is the beatdown, and he was in fact an innocent party if he was ambushed.

    Nothing illegal about cheating, and it's not like he was caught in the act. The other party followed and attacked him.

    As much as I am against cheating, I don't see how it affects this situation.

    Amen! While I've never been in this situation, if my wife decides run around on me, I would ruin her in court then find as many girlfriends as I could.

    Either go to jail, or be neck deep in tail.....hmmmm.....

    IMO the affair doesn't have any bearing on the situation. The guy was physically assaulted and defended himself.

    No idea at this point, I'm guessing he knew trouble was coming and kept the .38 real close. We don't even have a straight answer on if the guy is alive or not.

    On a side note, I worked at the place these guys worked at for a few days, honestly Id rather be in jail or shot as to keep working there.

    I've always believed that if you knowingly mess with another man's wife and get your ass shot off, it's on you.

    What part of SW Va did this happen? Utility Trailer?
