    You and your family are driving down a road where there are a lot of people because there is a fiesta of some sort. You have your licensed gun with you with a PTT since you've just been to the range. The road is almost a one-way street due to the crowd. There's no way for you to go fast. A visibly drunk man was blocking the road, knife in hand. He came by your side and tried to stab you through the close car window. Instinctively, you already have your gun in hand locked and loaded and squarely pointed at him.

    If the attacker tried to stab you again, breaks the window and you shot him till his dead or neutralized.

    Would you be legally liable?

    If a clear threat to your life is established then I guess this would qualify as a justifiable shooting.

    You might be charged with illegal possession or violating the rules of your PTT. It's either they cancel your firearms license or , worst case scenario, spend some time in jail.

    Ultimately it's how you and your lawyer handle it. Remember, the dead drunk guy won't be there to air his side so the only story in play is yours.

    Great help, bikethief. Thanks.

    I was wondering if the necessity of the use of the deadly force and the legal gun documents (while not equal to a PTC) could help keep the shooter a free man. I'm pretty sure time in jail would be a lot better than being cut to pieces, but sweet freedom isn't an easy thing to lose even for just some time.

  6. Pag licensed ang gun mo, di ka pwede ma charge ng illegal possession, kahit ilabas mo ang baril na walang ptc. The proper charge is bringing your licensed firearm, without PTCFOR, punishment is 6 months imprisonment.

    Basically, ang dale mo dun is not having a PTC, e dun pa lang,
    dapat unloaded ang firearm mo in-transit, with the gun and
    ammo stowed separately.... IOW, 'di mo rin naman magagamit
    sa scenario mo na 'yan, e.

    Pero naman, sabihin na nating dala mo ang boga, kargado, na
    wala ka'ng PTC. E, buhay mo na (at ng pamilya mo) ang nakataya,
    'di barilin mo na, and let the lawyers deal with it; or if you can
    settle all the crap out of court, it's better than you being dead,
    or God forbid, you losing a family member.

    BTW, if you've never tried shooting from inside a vehicle, it pays
    to imagine what "effectively doing so" demands, and how even
    a successful shoot adversely and immediately affects the vehicle's
    occupants.

    These days with cellphones capable of capturing video and audio, set it to record if you have the time or make the time. The audio will at least help you out argue your SD case.

    paano mo babanggain eh nasa tabi na, crowded street pa.

    imho, its self defense. as to why the gun is loaded, burden of proof is for the shooter to prove how he manage to retrieve the gun or the mag from his trunk (which is why one rear seat of my sedan is always unlocked, for me or my companion to easily retrieve the mag in case of trouble)

  16. pag naputok mo na yung baril mo, irrelevant na yung ptt, since it allows you to bring the gun, pero hiwalay ang bala. Kahit may PTC ka, pag ngamit mo ang baril mo, bale wala din, since the PTC does not justfy your using the gun to kill someone. Each case will have to be judged on the merits. The PTC just makes it easier for you to justfy why you had a gun with you in the first place. BUT if the scenario is not proper for a self defense claim, kulong ka pa din.

    For me, anong PTC or PTT or WHAT?
    A BG does that to me? Am willing to be MABINGI (or MAUBOS TUTULE KO) with the BLAST of my OPEN from the inside.

    Will get the services of our magagaling na lawyers dito: Taurus, GMV, Catsmeow, Young Once...mababait mga yan. MURA PA SUMINGIL.

    or kung gusto niyo...get the services of those nag-aastang lawyers sa senado - na tipong kanto boy ang dating - na mali-mali naman grammar - na NABUBULOL kapag may ibubuga ini-imbistigahan...kulungan bagsak tiyak!

    Ha ha... natawa ako dun sa ibang posts. Gumana pa kaya ang Auditory exclusion pag Open Gun ang ginamit mo:rofl:.

    Nice points, guys. Sabi ng kaibigan kung lawyer, madali naman daw gawan ng kwento yung PTT lang ang meron ka. Katulad nung palusot na nabanggit ni Alegra. Pag-nabasag daw yung salamin kasi inulit ulit nyang saksakin yung bintana, meron nang intent to kill yung siga so malamang pwede nang justifiable shooting pag na-boga mo sya. For sure kahit pa walang license yung baril mo e talaga namang puputukan mo yung uma-atake sau. Meron dito samin almost the same scenario. Binaril yung sigang nagwawala ng retired army (gamit lumang Remington 1911 nya). Abswelto na yung mamang retiree sa 20K na binayad sa pamilya. Pero, ingat yung matanda sa resbak kaya pina gawan ng mataas na bakod yung bahay nila.
