    It certainly may be. Just because they're running doesn't mean the threat has ended. If they still have a firearm and are capable of deploying it, the threat continues.

    Exactly - I know of a murder trial here where a robber was shot 3 times in the back running away and the guy got a not guilty, based on self-defense, using that defense.

    My Dept training has gone from 2 shots and wait and see to empty the mag and reload and empty it again and repeat until the threat isnt a threat anymore, ie not moving. Front/back/side/pelvis/groin/head/anywhere is ok to shoot.
    If its still moving, get the carbine and/or the 12G out of the trunk.

    We had one case where the bad guy took a shot over the top of his car at our guys who shot back of course. After 40++ rounds each he wasnt going down .....until then finally a 12G to his head knocked him down.....seems his pants were caught on the door lock and his body was wedged in the car door hinge. Oh well.

    There isn't a single word in our justification statute about where you have to shoot them. In fact, in some cases, our law makes it legal to shoot a person in the back who is unarmed and posing no threat - in others, you could be justified in shooting a person sleeping in his own bed. There is a lot more to it than you see in westerns.

    The only problem i saw is that he missed from a few feet away,just a few more range sessions should correct that

    Other than that great for him and everybody else.

    Way to go gramps! I'd love to know if this guy's history includes military service. I'd like to think I'd respond as decisively and effectively but will probably never know. I was going to say maybe next time he'll use something deadlier than a .380 but the .380 did the job of ending the threat.
