A friend of mine Randy used his shotgun in a self defense stand your ground shooting, it took a year for the PD to release his gun back to him, he killed the perp in his home, like I said they released the shotgun back to him, but want a $500 fee before he can pick it up, it's only a $200 dollar gun he wants it back but can't see paying the fee to get it returned, any ideas, he asked me to ask around to see if this is the norm.

I'd be on the horn to the FL attorney general asking why that local PD is extorting your friend.

    Get a GOOD lawyer.
Sue to have it returned. Include all court costs in suit.

Another reason to always have a spare around the place. Governments; even the lil local ones are NOT your friends. And we want them to take care of our health..... YIKES!!!!

sue the PD for withholding the victim's personal property and charging a fee for its return.

$500 for paperwork? I had a client that a similar thing happened to a while back. PD was trying to make him jump through a bunch of hoops to get property back. I wrote and called the City Attorney and told him to tell the PD to stop the shenanigans. My client got his property back in 24 hours.

tell your buddy it's cheaper to have a lawyer write a quick letter demanding your property back. What do they call it...a writ of gimme my sh** back or something...

So is every SD shooting in FL now a "stand your ground" bit? SD shootings have been going on long before the 7 or 8 year old "stand your ground law" was put into play yet suddenly it applies in every case....when in reality I'll bet it rarely does.

If I lived in FL, I'd buy a gun and give it to the PD. That way, they don't need the one I use to defend myself. KEep the gun and your $500 bill, Officer.

I'm waiting for the flood of coptalk regulars to show up and admonish us that this is perfectly fine, that any decision made by a LEO that's legal and within regs is the right decision, and because we haven't (and can't) do what they do then we just don't know.
