Draco + shoulder stock = SBR?

    I came in to work today and my boss (the owner) and his future son in law (both great guys and normally pretty smart) were standing around trying to decide the best way to attach an ACE skeleton folding stock to his Draco AK pistol. :wow::faint: I work for a small family-owned and operated auto repair facility (which for legal purposes shall remain nameless...) so drilling and tapping the back of the receiver would likely take about 10 minutes. I about **** my pants and said "umm guys I'm about 99% sure that makes it a Short Barreled Rifle, and thus illegal without a BATFE stamp/paperwork or something..." Am I crazy or were they about to get in some deep doo-doo? Also is it legal to have a forward pistol grip on it? I was pretty sure that's OK, but not 100%...

    It is even easier to get into trouble with the AR15 pistols...

    Take the short-barrel pistol upper off and put it on a rifle lower and presto... Instant illegal SBR. OK, may not instant, but 30 seconds or so for the swap.

    Shoulder stock makes it an SBR, short barreled rifle. Forward grip makes it an AOW, any other weapon. Both need BATFE approval and stamp.

    This might be a dumb question but what about adding a sling. Would the BATFE need to be informed.

  8. Sling is OK, vertical grip on AK interfere's with mag changes, if you want to add a stock to a Draco it's much cheaper to pay the BATFE up front.

    Use the front of the mag as a vertical grip instead.:cool:

    If memory serves...

    SBR - $200 tax stamp

    AOW - $5 tax stamp


    Tell him he is the owner of the company and can afford the $200 if he takes it out of your check:rofl:

    The $5 tax for AOW's only applies to transferring them on a Form 4. To manufacture one yourself on a Form 1 is still $200.

    Correct. Making tax is ALWAYS $200, AOW, SBR, SBS, etc.

    OP, as others have said, slapping a stock on that Draco is highly illegal. 10 years in federal PYITA prison and $250,000 fine illegal.

    If you pay for the sbr and suppressor tax stamp, do you also have to pay for a foregrip tax stamp?

    It would suck to have to pay $600.

    Once you pay the $200 tax stamp to SBR/SBS the item on a Form 1 (or it is xfered on a Form 4) there are no limitations to stock, foregrip, barrel length, etc.
