CCW question

    Ok i took my CCW course in begging of October, but i don't remember if the guy told me it was OK to have the gun a holster w/o a clip or if it's not ok to have a gun in holster while it's not clipped. i know it's a stupid question but that's the only thing i cant remember. I know everything else and im always looking online for recent changes in the law because he told me there was a law that is waiting to be passed in the end of November and to keep looking

    I am having trouble parsing your sentence and question as it is really confusing. I will try to answer what I think you are asking...

    FL Law is completely silent about types of holsters, how to carry a gun, etc. when you have a concealed weapons permit. The only time it talks about holsters at all is when you are carrying a gun in your car WITHOUT having a concealed weapons permit.

    Specifically, FL Statute 790.25 Lawful ownership, possession, and use of firearms and other weapons.--:

    (l) A person traveling by private conveyance when the weapon is securely encased or in a public conveyance when the weapon is securely encased and not in the person's manual possession;

    (m) A person while carrying a pistol unloaded and in a secure wrapper, concealed or otherwise, from the place of purchase to his or her home or place of business or to a place of repair or back to his or her home or place of business;


    It has been interpreted by the courts to mean that the pistol can be in a glovebox (locked or unlocked) or in a holster, as long as the holster has a snap or something that keeps the pistol from being drawn or falling out without first opening the snap.

    So, as long as you have your CCW license, you can carry any way you please, including Mexican style, tho that is not recommended. Buy the best/most comfortaqble CCW holster you can find and use that.

    I think by reading your question your refering to the retention strap. As GlocknSpiehl stated, there is no laws concerning the method of cc when you have your CWL. Meaning you can have a holster with a retention strap or not, it is all personal preferance. I personally carry a G23 in a CB SuperTuck (no retention strap).

    "Securely encased" applies only if you DO NOT have a FL CWL (concealed weapons license). If you have a FL CWL you can legally carry it concealed on your person any way you wish, even without any holster at all.

    Again, as I said earlier, that part of the law applies to persons WITHOUT a CCW.
