    GRNC Alert 5-17-07:

    HB 1847 now prosecutes YOU...

While criminals 'get out of jail free!'

HB 1847, "Report Lost or Stolen Guns," just got worse, passed out of
committee in an 8-5 vote, and will hit the NC House floor on Monday.
Whether or not you have sent previous messages to House members, ACT
NOW by sending the *new* automated e-mail message available at:

Originally, the bill gave you 48 hours to report gun thefts or else
face potential criminal prosecution. It wrongfully prosecuted the
*victims* of property crimes instead of perpetrators and exposed gun
owners to prosecution for guns they might not even know were stolen,
all in the name of fighting alleged "illegal gun trafficking."

    'Committee Substitute' Worse Than Original

But lobbyists from North Carolinians "Against Gun Violence," who
drafted the bill, hadn't yet delivered their final insult: This week,
they amended the bill so that lawful gun owners will be the ONLY ones
prosecuted, while real "gun traffickers" benefit from a
    "Get-Out-of-Jail-Free Card."

How so? Under the new language, if a criminal illegally buying and
selling guns simply reports them stolen, he is not only off the hook
for any crime committed with them in the future, but the bill also

That's right: Under HB 1847 law-abiding gun owners would be the ONLY
PEOPLE PROSECUTED! Demonstrating that their target is lawful gun
ownership, NCGV lobbyists have shed any pretense of going after
criminals: Their bill now *facilitates* gun trafficking while going
after YOU, the lawful gun owner, for the "crime" of not knowing your
    gun was stolen.

HB 1847 comes up for a House vote as early as Monday. Your response
must be immediate and forceful. Politely but in no uncertain terms
you must tell House members that you will not tolerate being
subjected to potential prosecution, especially while gun traffickers
    receive a "Get-Out-Of-Jail-Free Card."

    Dear Representative:

HB 1847, "Report Lost or Stolen Gun," has morphed into a "Gun
Traffickers' Get-Out-of-Jail-Free Card." Remarkably, the bill's
sponsors, while claiming the bill is needed to prevent illegal gun
trafficking, have amended the bill to *prevent gun traffickers from
being prosecuted* for guns bought illegally.

The committee substitute adopted and passed from the Judiciary I
Committee included the following new language under G.S. 14-406.1(c):
"...a person who reports the loss or theft of a handgun obtained by
the person in violation of G.S. 14-402(a) SHALL NOT BE HELD CRIMINAL
LIABLE FOR THAT VIOLATION..." (emphasis added).

The statute referenced above, G.S. 14-402(a), stipulates that handgun
buyers must get a pistol purchase permit from the sheriff-including a
background check--before buying a handgun. Therefore, under the
latest version of HB 1847, if a gun trafficker reports guns he plans
to sell as "stolen," he is not only off the hook for any crime
committed with them in the future, but the bill also prevents
prosecuting him if he bought the guns illegally!

Under HB 1847, the *only* people who will be prosecuted are lawful
gun owners who might not even know their guns were stolen. Meanwhile,
law enforcement authorities will be hamstrung in trying to prosecute
    *real* gun traffickers.

I look forward to your support in defeating HB 1847--a bill which not
only gives a "Get-Out-of-Jail-Free Card" to criminals, but will
subject lawful gun owners to wrongful prosecution. By monitoring your
actions via Grass Roots North Carolina legislative alerts, I will
reward that support in upcoming elections.
