Alimony question

    After a 2 year marriage, what are the odds of my friend's ex wife getting alimony even though she makes more money than he does?

    There are no children, no debt, no property, etc. Its all very clean and straightforward.

    Alimony is usually only awarded to the spouse when they are unable to support themselves due to being unemployable (a stay at home mom with no marketable skills after a long marriage for example) or they are unable to work because of a disability. I'm no lawyer but I did stay at a Holiday Inn Express last night. Seriously, if I was a gambling man I would bet that she would not get alimony based on the few facts you provided.

    If he will be required to pay alimony and gets stuck with the debt and spousal support many states will allow you to pay down the aquired debt the couple incurred while married with the equalivant payment.
    I.E. Spousal Support equal $1000 per month X 24 months.
    Combined debt equals $ 40000.
    20 payments of $1000 equals her half of the aquired debt, you give her $4000 and take the debt.
    Believe me in the long run if this is your situation it is in your best interest to do it this way.
    If SHE is the Spouce with the greater yearly income reverse this, but as a kicker in negotiations offer to take no payment and get out of the debt and run, run far away.

    IN a perfect world there should be NO $$$ passed. "we tried, failed, have a good life"

    IF they both make a "liveable" wage and neigher one supported the other (while the spouse took training to get higher paying career) alimony should not enter it.


    BUT the judge can do (almost) whatever they want. If your "friend" looses his cool, lets his buttons get pushed... It can cost him BIG TIME.

    Maybe your friend should hit up his ex-wife for alimony.
