Man faces murder charges after fatally shooting car thief

He had planned to stop at a gas station before visiting his mother in the hospital, but Raheem Scott never made it, his mother said. Scott left his car running when he went inside the Exxon near The Mall West End. And when he came back outside, another man was in the front seat, according to Atlanta police. Scott then allegedly fired multiple shots, killing William Blackwell, 50, of Goodlettsville, Tenn. Scott then went back inside the store and asked an employee to call 911. He was arrested and charged with murder, according to police. “The use of force which is intended or likely to cause death or great bodily harm to prevent trespass on or other tortious or criminal interference with real property other than a habitation or personal property is not justified unless the person using such force reasonably believes that it is necessary to prevent the commission of a forcible felony,” Georgia law states. Scott waived his first court appearance Monday morning. He was being held without bond at the Fulton County jail. Scott’s next court date is scheduled for April 4.

He is not the first guy who went outside of appropriate force and gets a murder charge and sadly will not be the last. Some are more blatant.

First mistake was leaving his car running. Seriously, who does that? Beyond stupid in my opinion. I think he will be convicted and rightly so. The car thief posed no threat to Scott or anyone else.
+1 Excellent point. Property theft, no threat and made possible by the car owner. You're OUTTA HERE!!!!!!!!!!

How many times have you parked your car in front of a stop and rob, gotten out, locked your doors, and gone in the store. How many times have you done the same thing and the car next to yours is empty, unlocked, windows down, engine running, and "noise" blasting from the speakers. Sounds like more Democrats killing Democrats. Also, don't forget this happened in Atlanta. Not exactly Mayberry. Be safe out there.

Like writing a bad check could theoretically get one killed in your state if the shooter knew the funds were not in the account? Or stealing a case of Budweiser from a delivery truck left unattended?

I doubt "any felony" in any one of the 50 states justifies deadly force, and it's entirely possible the shooter in this case thought he was justified when he clearly was not (unless he can prove he was in imminent physical danger).

Who would want their car back with bullet holes and some criminal's blood all over it???

Let him steal it, and then hope for the best with your insurance company!
One thing much worse than driving your car you got back with blood and bullet holes is driving you car with blood and bullet holes to your own trial.

Gas stations almost always have many cameras. Claiming he was about to run you over while the recordings tell a different story will make it even worse.

The state law either has to change TX style, or we have to let the property go. I wouldn't mind Texas laws nation wide.

Grand theft auto is for me on the same level as burglary or kidnapping.

I just learned something during a case of road-rage turned deadly here in Louisiana. It's been on national news because some IDIOT shot and killed a young NFL player. NFL player wasn't armed but neither shoulda gotten out of their car. All details aren't released but the shooter shot him 3 times and the man died on the scene. This guy was in trouble for a similar incident in 2010 (?) so he's got a track record. WHAT I LEARNED:

In LA we are the only (or one of the few) states to attach "Castle Law" doctrine to your car. That is if someone gets in or attempts to get into your vehicle and you feel threatened you can shoot them. Now, again, all details and facts aren't in and the perp has been released for now. The NAACP crowd is predictably getting in front of cameras, chanting, singing and carrying signs about a lynching. It would be different if the racial roles were reversed <yawn> but NObody has all the facts and witnesses seem scarce. IMO, it should NOT have happened and skin color doesn't matter. I'll wait for more details but at this point it looks like a bad shooting. We'll see....

These days who would leave their car running and unattended in a public area? OTOH that would probably be a good shoot here in Texas.

I personally have no problem with it. I witnessed the theft of a Jeep in a campground a couple years ago, but was unaware that the driver was not the owner. Dude unhooked the Jeep right from a motorhome with the owners inside at 7:00 in the evening. I walked right by and thought the owner was having a tough time getting it cranked. The Alabama deputy told me it was ok to use deadly force in that case.

Being in a bank and someone comes in to rob it with a gun, justifiable deadly force, outside a motor home, no threat to life other than someone stealing a car and then killing him? Not sure about that. Coming out of a store and someone is sitting in your car that you left open and running, then taking his life, wrong decision by ccw holder.

If you go in a gas station in Atlanta and leaves his car running outside, he isn't smart enough to carry a gun or stay out of prison.

On the other hand, all he would have had to do to make this a legal shooting is try to stop the guy before shooting him. The use of any force or threat to steal the car would convert it to the "forcible felony" of robbery and he wouldn't be in jail right now.

My brother did this... guy takes off with his vehicle.

My brother calls me... blah blah blah... I thought it was funny considering nobody got hurt.

Half hour later, I'm headed into work at the family business, and what do I see? His truck headed down 10th avenue in Myrtle Beach with a cop car in front of it. Wasn't 100% sure it was his vehicle.

I see the truck twice more that day infront of bars. This was before the era of cell phones. Eventually recovered the car that night minus an expensive set of golf clubs.

Life sucks for the C/C holder.
