April 11, 2012, 21:15 - After the first thread went for close to 1,400 posts without trouble, I hoped I would not have to make this post, but some members in the first 60 posts here seem to neither understand civil discourse, nor staying on topic, nor the prohibition of racial baiting and trolling.

Was just listening to a talking head. They *think* the charge will be Manslaughter, but the issue may be Florida's Stand Your Ground law, and it may not get to trial. A judge could possibly rule it self defense and dismiss the case before it gets to a jury (not that I think that will happen)

I'm very concerened that the charges are coming from "political" pressure....... Hopefully we will see what the evidence is to date........

The judge wouldn't do that, he/she wants to be elected again.
The jury won't want to say innocent for fear of their own lives, if the jury pool is made public.
The DA seems to have convicted so the DA can be elected.

Now if you're Z, do you take it to a jury or a judge if it goes that far?
My leaning with what's been in the press, is to go to a bench trial. I figure that a judge is more likely to apply SYG than 12 random guys.

I'm with you, Sam. I'd request a bench trial.
I just pray the case is not moved to Jacksonville....for purely selfish reasons. I feel bad for the residents in whatever venue to which this case is moved.

According to prosecutor - Florida law,factual evidence, physical evidence, and testimonials have lead her to this decision.
Her findings lead her to believe that this was not justifiable homicide but in fact 2nd degree murder.

Her lecture sounded like they were out to find any possible reason to convict him...

Then why not entrust that to a grand jury?
Answer: Because a grand jury can't be trusted to deliver the political indictment being sought.

As F'ed up as NJ is, at least all indictable charges go to the Grand Jury. The Prosecutor can charge whatever he wants, but the Grand Jury ultimately decides what stands.
