Gun culture clash puts U.S. man in Canadian jeopardy

Louis DiNatale claims he and his wife were heading to Vermont from their home in Kentucky last September when an accidental detour led them to the Canadian border. That detour is now costing the couple thousands of dollars and garnering media attention throughout Canada and the U.S. and it could mean jail time in Canada for DiNatale.
All because of what many Americans consider a right: his possession of a gun.

Big wrong turn for man carrying gun in car may lead to 3-year jail term

According to Louis DiNatale, he had forgotten about the Bersa .380 handgun he had stowed in the center console.
Agents searched the car, found the gun, and arrested DiNatale for attempted gun smuggling and lying to border patrol agents. He was released four days later, and a court date was set for June. If convicted, DiNatale, a retired Army sergeant major, faces three years in a Canadian prison.

So am I to be outrage that Canada enforced their laws?

Should I be outraged that a man was not able to remember where he left his gun?

Should I be outraged that a man did not tell the truth when asked if he had a gun in the car at the Border?

I wish him well, but the consequences of his actions fall squarely on his shoulders!

There's a big difference between lying, & making an honest mistake. There's also a difference between accidentally ending up in a geographic location that makes what you're doing illegal, and simply doing something that you know is illegal where you are.

The question here is intent; not violation (which is clear). He didn't plan to leave his gun unsecured or to bring it with him. He didn't plan to get lost, or to go to Canada. He didn't plan to smuggle, sell, or use the gun. All his actions prove that he had no mens rea.

IDK if that's relevant to his guilt & punishment under Canadian law, but it is in the US, which is why it's newsworthy & discussionworty here.

Concealed guns lead to border arrests

August 15, 2014 - The Canada Border Services Agency (CBSA) arrested two men from the U.S. trying to bring concealed weapons into Canada at North Portal, bringing the yearly total of seized firearms to 27.
